Intention of the Central Government (CG) looks clear on implementation of Goods and Service Tax (GST) in the Country. However, on close reading of Clause 18 the Constitution (122nd Amendment) Bill, 2014 and its impact on the general business and commerce in the Country, it appears that the things are absolutely different than what is being projected before the public at large on GST front.
The much talked about Goods and Services tax (GST) Regime has been creating a buzz amongst all, eagerly waiting for the monsoon session of the Parliament to commence with the hope that the much awaited Constitution (122nd Amendment) Bill, 2014 on GST (‘122nd CAB’or ‘GST Bill’) will be passed.
The Government remains committed to roll out the Goods and Services Tax (GST) from April 1, 2016. Currently a Central GST Law and a model legislation for the States were being drafted to levy GST on intra-state supplies; on inter-state supplies and levy of GST on imports.
The Constitution (122nd Amendment) Bill, 2014 was introduced in the Lok Sabha on December 19, 2014 by the MoF which seeks to amend the Constitution to introduce GST. GST is a simplified indirect tax structure, wherein tax paid on goods/services procured by one person at one stage can be availed as credit while passing on the goods/services to the next stage, until they reach the final consumer who bears incidence of tax.
Presently Indian Economy has various taxes on Goods and services such as VAT, Service Tax, Excise, Entertainment Tax; Luxury Tax Etc so with coming of GST there shall be single Taxation System. GST is an integrated scheme of taxation that does not discriminate between goods and services. GST chains commence from manufacture of Goods & ends at final consumer of goods who bears the tax burden.
