The mammoth fraud at IT major Satyam, involving over Rs 14,000 crore as per CBI, proved to be the most brazen swindling act, forcing the government to re-write corporate governance rules during 2009 and tighten the norms for chartered accountants. While the investigating agencies had a tough time going through voluminous documents to get to the extent of the scam and uncover the modus-operandi of the fraud, disclosed by the company’s founder and then chief B Ramalinga Raju himself in January, it could still take quite some time for the courts to punish the guilty.

Although there is a school of thought that legal consultants do not provide any service to their client, I hold my distinguished predecessor in high esteem and disagree! As such, I propose to extend Service Tax on advice, consultancy or technical assistance provided in the field of law. This tax would not be applicable in case the service provider or the service receiver is an individual.

No. 54-EL(1)/18/ 2009: In exercise of the powers vested under clause (2) of Para 6 of Schedule 6 to the Chartered Accountants (Election to the Council) Rules, 2006 read with Regulation 134 of the Chartered Accountants Regulations, 1988, the undersigned after satisfying himself, as the Returning Officer of the elections to the Twenty First Council and the Twentieth Regional Councils, that the polling held on 5th December, 2009 in polling booth No. C-097 in Aryan Public School, Sector-IV, Vaishali, Ghaziabad (UP) has been interrupted/ obstructed with sufficient cause, hereby declare that the polling held at the said polling booth on 5th December, 2009 was void and consequently order a fresh polling on 18th December, 2009.
