CBDT reinstated TDS rules and forms existed prior to April 1, 2009

The Central Board of Direct Taxes (CBDT) has reinstated the tax deduction at source (TDS) rules/ forms that were earlier discontinued with effect from April 1, 2009. This latest move, which would come into effect retrospectively from April 1, 2009, clearly indicates that the Income-Tax Department is not looking to implement the concept of unique transaction numbers (UTN) for sometime to come, say tax experts. In March 2009, the CBDT had stipulated that assesses filing return for assessment year 2009-10 or any other earlier assessment years should provide the UTN.

Deduction under section 80-I allowable without setting off loss of other units: Delhi High Court

The assessee had two units, namely, a steering unit and an axle unit, both of which were eligible u/s 80-I. While one unit was making profits, the other was incurring losses. The AO and CIT (A) took the view that deduction u/s 80-I on the profits of one unit could be allowed only after setting off the losses of the other unit.

Section 14A and Daga Capital can not put assessee in worse position. In other words section 14A disallowance under Rule 8D can not exceed original disallowance made at the time of assessment.

Even if there is no assessment u/s 143 (3), reopening u/s 147 is bad if there are no proper “reasons to believe”. AO cannot go beyond the recorded reasons

The assessee was a partner in a firm. Upon retirement, he received an amount of Rs. 50 lakhs in addition to the balance lying to his credit in the books of the firm in full and final settlement of his dues. The assessee filed a return in which the said amount was not offered to tax on the ground that it was a capital receipt. No assessment order was passed.

In order to claim a bad debt as a deduction under section 36(1)(vii) of the Income tax Act (Act) it has been a long drawn controversy between the Taxpayer and the Revenue whether in addition to write-off the debt in the books of account, it is obligatory on the Taxpayer to establish that such debt has become a bad debt, especially after the amendment brought in by the Direct Tax Laws (Amendment) Act, 1987 w.e.f. 1 April 1989.

Personal income tax exemption limit should be further increased by Rs 50000 and slab limits should be revised accordingly. Currently, the threshold tax exemption limit for all assessees – for women is Rs 1,90,000, for senior citizen is Rs 2,40,000 and for others is Rs 1,60,000.

Nowadays I am receiving one or more email daily with subject ‘Tax Refund Notification’. With mail I receive a attached form in which they ask bank account details. This is the trap Once you enter your bank account detail which includes your username and password the same get stored in the database of the person sending fraud emails. After receiving your username , password they transfer all your money in their bank account.

Income Tax refund scam: TV actors, IT officials are in CBI net

The CBI on Sunday arrested three income tax (I-T) officials and two of their accomplices in connection with a Rs 3-crore fraudulent tax refund scam. The arrested I-T officials are inspector Pramod Prabhakar, tax assistant Raju Nagpure and senior tax assistant Rajesh Pillai. Another I-T official Shrikant is on the run. The others who have been arrested are Dilip Vyas and Manoj Sangtiyani, a little known television actor.
