Under the third phase, the MCA has released draft rules relating to the following chapters. The last date of receiving comments on draft rules released under the third phase is 1st November, 2013.
Whereas the Companies Act, 2013 (18 of 2013) (hereinafter referred to as the said Act) received the assent of the President on 29th August, 2013 and section I thereof came into force on the same date; And whereas the provisions contained in section 24, section 58 and section 59 of the said Act have come into force on the 12th day of September, 2013;
It is hereby clarified that with effect from 12.09.2013, the relevant provisions of the companies Act, 1956, which correspond to provisions of 98 sections of the companies Act, 2013 brought into force on 12.09.2013, cease to have effect from that date.
Ministry of corporate Affairs has also notified 98 sections for implementation of the provisions of the companies Act, 2013 on 12.9.2013. Certain difficulties have been expressed by the stakeholders in the implementation of following provisions of the said Act.
