In exercise of the powers conferred under Rule 49A of the Delhi Value Added Tax Rules,2005, I, Vijay Kumar, Commissioner, Value Added Tax, do hereby extend the last date for filing of online return for the 1st quarter of the year 2015- 16, in Forms EC-II and EC-III as notified vide Notification No. 3(515)/Policy/VAT/2015/330-341 dated 26/06/2015 to 30/09/2015.
The Government remains committed to roll out the Goods and Services Tax (GST) from April 1, 2016. Currently a Central GST Law and a model legislation for the States were being drafted to levy GST on intra-state supplies; on inter-state supplies and levy of GST on imports.
In various cases it was decided that the Hire Purchase is taxable under state VAT and CST even though the hirer is not the owner of the goods during the tenure of the Hire Purchase Agreement. The financing company will be the owner of the goods under consideration till fulfillment of all conditions of Hire Purchase Agreement.
Recently, on 13th July, 2015, Maharashtra Government has come out with a Trade Circular No. 11T of 2015, clarifying that recent decision of Bombay High Court is comprehensive and it is now well-settled that VAT can be levied on transfer of right to use goods of intangible nature even if it is transferred to multiple users.
Circular 7T of 2015 have already simplified registration process under MVAT and CST Laws by making the entire registration procedure online. According to the Circular, application for Registration is to be filed online along with scanned documents and photographs. After filling the form online Registration Certificate shall be granted.
