SC stays CBI investigation in multi-crore foreign exchange losses to customers on derivative products sold by banks

The Supreme Court today stayed the Orissa High Court order for a Central Bureau of Investigation (CBI) probe into the alleged Rs 25 lakh crore derivatives scam. A Bench headed by Chief Justice KG Balakrishnan issued notices to the parties involved on appeals moved by the Fixed Income Money Market & Derivatives Association (Fimmda), the Indian Banks Association (IBA) and several others challenging the high court judgement.

Banks located in non-processing zone of SEZs are not offshore banking unit and not eligible for tax benefits

In an effort to prevent misuse of the tax benefits provided to special economic zones (SEZ) and increase clarity to the policy, commercial banks and their ATM units that are located within the non-processing zone of the SEZs would not be granted the status of an offshore banking unit (OBU). They will, therefore, not enjoy the incentives meant for OBUs.

The Reserve bank of India has asked banks to reveal more information on their market operations, including data related to top 20 depositors, 20 largest borrowers, exposure to four largest non-performing accounts and special purpose vehicles sponsored by them, for the current fiscal.This, officials said, was to ensure the industry followed international best practices and to enhance transparency in banking operations. The disclosures are to be made part of the ‘Notes to Accounts’ in banks’ balance sheets.

Many Government companies not submitted their financial statements with ROC for as long as 26 Years

The corporate affairs ministry has decided to act tough with public sector undertakings (PSUs) that have not prepared and submitted their financial statements with the registrar of companies. As many as 658 state-run PSUs have piled up 2,539 accounts, with some pending for as long as 26 years.

The deadline to implement the International Financial Reporting Standards (IFRS) looks set to be extended to April 2012 from April 2011 for banking companies. It is learnt that banks may get more time to implement IFRS. The deadline for Indian companies is April 2011. However, the deadline for banks may be extended to April 2012.

ICAI looking to bar firm whose partner found guilty of Auditing fraund or Negligence

The Indian accounting sector regulator wants the government to bring in a provision to bar tainted firms from taking up any new assignments for a specific period. The move by the Institute of Chartered Accountants of India (ICAI) is the latest in its undeclared but continuing tiff with the Big Four foreign accounting and audit firms that has escalated after the Satyam fraud.
