The following officers in the grade of Principal Commissioner of Income Tax (HAG, Pay scale Rs.67,000-79,000) (pre-revised) are, hereby, promoted on ad-hoc basis to the post of Chief Commissioner of Income Tax (HAG+) in the Pay Scale of Rs. 75,500-80,000/- (pre-revised) for the panel year 2016-17 with effect from the date of assumption of charge of the post and until further orders.
Sections 194C(6) and Section 194C(7) are independent of each other, and cannot be read together to attract disallowance u/s 40(a)(ia) read with Section 194C of the Act; and If the assessee complies with the provisions of Section 194C(6), no disallowance u/s 40(a)(ia) of the Act is permissible, even there is violation of the provisions of Section 194C(7) of the Act.
Thus, post 1st June 2015, in the course of processing of a TDS statement and issuance of intimation u/s 200A in respect thereof, an adjustment could also be made in respect of the ‘fee’, if any, shall be computed in accordance with the provisions of section 234E. Prior to 1st June 2015, there was no enabling provision therein for raising a demand in respect of levy of fees u/s 234E of the Act.
I am also directed to state that as per CVC guidelines, the inquiry proceedings under CCS (CCA) Rules, 1965 are to be completed in six months.The Member (P&V), CBDT has desired that in all the cases where a period of more than six months has passed since appointment of inquiry officer, further time of three months may be allowed for completion of inquiry proceedings.
