Division Bench of the Hon’ble High Court of Delhi (Justice S.K. Kaul and Justice Rajiv Shakdher) in their interim order in Writ Petition No. 5237/2011 Kannu Aditya (India) Ltd. Vs. Union of India, made on 26th July, 2011 have ordered: It is directed that no allotment shall be made till the next date of hearing.
DGFT has published the list of successful allottees for allocation of 10,00,000 MTs of non-Basmati rice for exports as notified in Notification No. 60 dated 19.07.2011 along with the 1st waiting list. The document submission, scrutiny and issue of registration certificates by the Regional Authorities of DGFT / DGFT(Head Quarters) (depending upon the choice of the allottees) would commence at 1000 Hrs on Thursday 28.07.2011 and will close at 1700 Hrs. on Thursday 18.08.2011, as mentioned in the Notification No. 60 dated 19.07.2011 subject to conditions mentioned therein.
Had stated that the declaration of allocation of quantities against the applications received from 20.06.2011 to 25.06.2011 will be made on 06.07.2011. In response to this PN a total of 581 applications were received by e-mail. Some applicant had sent more than one e-mail. Some e-mails have been received from applicants who did not have any export performance in either of the past two cotton years. Some applicants had been defaulters. If all these applications are not counted then the number of eligible applicants come to 227.
Was issued allocating a quantity of 19 lakh bales of cotton for export among 928 applicants for registration of contracts. In terms of Note (i) of Registration Certificate, the exporters who have got Registration Certificates from the four Zonal offices of DGFT at CLA Delhi, Mumbai, Kolkata & Chennai and DGFT(HQ) were required to submit the proof of shipments within 10 days of last shipment.

For services rendered after 1-7-2010 for which payment has been or is made after 1-7-2010, service tax is leviable and builder is liable to deposit the service tax to the service tax department. The only exception to this is provided within the parenthesis ( ) in the Explanation in para 3.For services rendered after 1-7-2010 for which payment was made prior to 1-7-2010, service tax has been exempted by the Govt. based on documentary evidence vide notification No. 36/2010-S.T., dated 28-6-2010 as amended. Therefore, this benefit can be availed by builders on the basis of documentary evidence.
A Service Desk has been set up with a national toll-free number 1800 425 4251 which can be accessed by taxpayer between 9AM to 5PM on all working days (Monday to Friday). Besides they can send e-mails (24×7) at e-mail ID (aces.servicedesk@icegate.gov.in). ACES Service Desk generates a unique number called the ticket number and ticket is closed only on resolution of the problem and confirmation by the complainant. If the user gives the required details, the issue is analyzed for resolving at Service desk itself (L-1) and if not possible, the issues are escalated to the L2/L3 team for resolution. Once the resolution is received the same is communicated to the persons concerned, via e-mail and on receipt of confirmation the calls are closed. Since the existing Nos. of telephones are not sufficient to handle pressure during peak filing periods as sometimes the phone lines may be busy, the taxpayers are hereby advised to send e-mails to Service desk.
