Income Tax Appellate Tribunal (ITAT) Mumbai ruled in favor of Sejal Jignesh Shah in an appeal against the Commissioner of Income Tax (Appeals), NFAC, Delhi, concerning the Assessment Year 2012-13. The primary dispute revolved around the reopening of assessment proceedings under Section 147 and the addition of ₹8.01 crore under Section 68 of the Income Tax Act. The Assessing Officer (AO) alleged that the assessee engaged in penny stock transactions with M/s Banas Finance Ltd., which was flagged for facilitating tax-exempt capital gains through stock price manipulation. The AO relied on an investigation report and treated the transaction as an accommodation entry.
The assessee argued that the reopening of the assessment was based on borrowed satisfaction rather than an independent opinion formed by the AO. Additionally, the assessee contended that all necessary documentation, including contract notes, bank statements, and dematerialization records, had been submitted to prove the legitimacy of the transactions. The ITAT examined the evidence and found that neither the assessee nor her broker was named in any investigation reports. It also noted that the transactions were executed through recognized stock exchanges and settled via banking channels, thereby raising doubts over the AO’s claims.
