Certain representations have been received seeking clarification whether for calculation of NFE the imports effected by 100% EOUs/Units in the EPZ are to be deducted or not. In this context, it is clarified that Paragraph 9.5 of Handbook of Procedures(Vol.1) clearly stipulates that Letter of Permission/Letter of Intent issued to EOU/EPZ/EHTP/STP units by the concerned authority would be construed as a licence for all purposes.
The export proceeds realised in any currency shall be converted, except in cases where the entire imports and the entire exports are made in one foreign currency, into US Dollars at the exchange rate prevailing on the date of issuance of EPCG licence which has been endorsed on the reverse of the licence with a view to ascertain whether export obligation has been fulfilled or not.
For taking supplies from such Private Bonded Warehouses no further endorsement of any kind on such specific licence or Advance Licence from the Licensing Authorities would be required. Accordingly, these licences which are valid for imports would be valid for taking supply from Private Bonded Warehouses also.
.Certain instances have been brought to the notice of DGFT wherein some of the exports effected by 100% EOU/ units in the Export Processing Zones are also being counted towards discharge of export obligation under advance licences or wherein DEPB benefits are being claimed. Thus the same exports are also being counted towards benefits under DEPB/advance licence as well as for discharge of export obligation by EOUs/EPZ units.
Attention is invited to the entry at Sl. No. 25 of Schedule 2 Appendix 1 of the book titled “ITC(HS) Classifications of Export and Import Items 1997-2002” and the Policy Circular No. 2 (RE-98)/98-99 dated 24.4.98 issued in this regard.
The matter has been re-examined in view of the fact that the DEPB rate for the formulations is likely to be notified shortly, it has been decided that the export of formulations of bulk drugs namely injection/Intravenous infusion/Syrup /Oral Suspension/ Tablet/ Capsule under DEPB scheme may be allowed provisionally even if no DEPB rate exist for such bulk drugs.
In respect of cases where Gold/Silver/Platinum has been booked with the nominated agencies but exports have not been effected within prescribed time limit, but have been completed subsequently, in respect of bonafide exporters, such cases may be regularised on payment of penalty equivalent to interest @24% on duty involved in such booking of the metal, for delayed period of exports.
Attention is invited to Ministry of Commerce (Import Trade Control) Public Notice No.74-ITC(PN)/85-88 dated the 21st February, 1986 on the subject mentioned above. It is hereby informed that in pursuance of the relevant provisions contained in the Indo-USSR deferred payments protocol dated the 30th April, 1981 and 23rd December, 1985.
This notification is issued for continuance of deemed export benefits for supplies made to Thermal Power Project of MPEB in the wake of withdrawal of World Bank Loan for this project subject to the terms and conditions mentioned in the foregoing Paragraph and in Appendix XVIII of the Hand-Book of Procedures (March, 1994 edition).
Public Notice No. 10 (RE-98)/1997-2002 outlines new DEPB credit rates for exports from April 1, 1997, and corrections to prior notices effective from April 15, 1998.
