Subject: Provisional Shipment under DEPB pending fixation of DEPB rate.

1. Attention is invited to paragraph 7.50 of Handbook of Procedures (Vol.1), (RE–98) 97-2002 which interalia prohibits exports under the DEPB Scheme unless the DEPB rate of export product is notified.

Representations have been received from pharmaceutical exporters that DEPB rates for all formulations of bulk drugs have not been notified and consequently the shipments are not allowed under the DEPB scheme even provisionally in view of the conditions stated in paragraph 7.50.

The matter has been re-examined in view of the fact that the DEPB rate for the formulations is likely to be notified shortly, it has been decided that the export of formulations of bulk drugs namely injection/Intravenous infusion/Syrup /Oral Suspension/ Tablet/ Capsule under DEPB scheme may be allowed provisionally even if no DEPB rate exist for such bulk drugs.

2. Attention is also invited to DEPB rates for textile products for which value cap has been imposed under Col. 4 of DEPB rate. It has been decided that wherever value cap exist for DEPB entitlement, the export product shall include `with or without’ embroidery .

 This issues with the approval of DGFT.
