The learned Principal District and Sessions Judge, Dwarka is found to have committed a grave error while disposing of the criminal revision petition filed by the state in the case titled ‘State (Government of NCT of Delhi) vs. Vinay Aggarwal & Anr.’ decided on 08.05.2021 by holding that the magistrate did not err in exercising or assuming jurisdiction in entertaining and releasing the seized oxygen concentrator, for the reason that the oxygen concentrator does not come within the definition of essential commodity under Essential Commodities Act, 1955.
