EXTENSION OF ANNUAL RETURN 9 & 9C for Y 2018 – 19 : With great difficulties, taxpayers have filed Yearly return 9 and 9C for Y 2017 -18. GSTN did not solve problems which taxpayers have faced while filing Y 2017-18 returns. While filing Y 2018 -19 returns, many of AUTO POPULATED fields not displayed. Multiple error relating to Offline utility and Server are being faced. Looking at these problems, we need to extend the dates. GSTIN should be guided to take cohesive action on this front and test the utility and server rigorously. Portal should be closed for maintenance and should be live only when all problems are solved. As such, last date of filing returns should be 30th June 2020, subject to proper working of portal.

We understand that the said advisory is inter-alia founded on the strength of a condition / restriction laid under sub section 4 of Section 16 of the CGST Act, 2017 that any registered person shall not be entitled to take any credit in respect of any invoice or a debit note, if the said registered person has filed the GSTR 3B return in respect of the tax periods July 2017 to March 2018 after 30.04.2019 and/ or the tax periods April 2018 to March 2019 after 20.10.2019 respectively.

Considering facts that as per Section 50 of the Central Goods and Services Act, 2017, interest is payable on the delayed payment of tax and that as per the interest statement filed along with the impugned letter, dated 07.02.2020, there was delay in filing GSTR-3B and hence, interest on ‘cash set off’ and ‘ITC set off’ has been calculated and payment thereof has been asked for, recovery of interest against the petitioner, insofar it relates to `I.T.C. set off, shall remain stayed.
As you are aware, Rule 36(4) of the CGST Rules 2017 notified w.e.f. 09.10.2019, restricts availment of credit to 120% of the eligible credit based on invoices/debit notes uploaded by the supplier in their GSTR-1. From 1st January 2020, the eligibility has got reduced to 110% of such eligible credit.
