Notification No. S.O.100(E)-Income Tax In exercise of the power conferred under section 80-IA of the Income-tax Act, 1961, read with sub-rule (2) of rule 18C of the Income-tax Rules, 1962, the Central Government hereby makes the following scheme to develop, operate and maintain special economic zones for the period beginning on the 1st day of April, 2001, for the zones developed on or before 31st March, 2006.
Notification No. 5-Income Tax Notes: The notified institution is advised to apply in triplicate and well in advance for renewal of the approval, to the Central Government through Commissioner of Income-tax/Director of Income-tax (Exemptions) having jurisdiction. Three copies of application for renewal of approval shall also be sent directly to the Secretary, Department of Scientific and Industrial Research.

Even if the ground about contravention of the provisions of Section 11(5) of the Act is validly taken by the respondent, the same would have a bearing only at the point of time of the assessment of the petitioner-trust and would not be a material consideration in so far as granting of approval under Section 80G(5) of the Act is concerned.
