Toady Nation Association of Tax Professional (Haryana) submitted a representation to the worthy Finance Minister of India for permitting taxpayers for availment of Input Tax Credit under GST u/s 16 up to the period for the period completed on 31st  March 2020 up to  31st December 2020.

Respected Sir,

Subject: Request for permitting taxpayers for availment of Input Tax Credit under GST under section 16 up to the period completed on 31st March 2020 up to 31st December 2020.

We are proud chapters of the National Association of Tax Professionals (NATP) which incorporated with a vision to work as a bridge between Tax Payers and Government for smooth, safe and secure, direct and indirect tax compliances. NATP consists of members, coordinates from all States and Union Territories of India.

The aim and object of NATP are to put the clear and unambiguous ground-level picture before Government to enable it to understand the ground level taxpayer and make necessary changes in law and procedures for compliances. At the same time, it is our aim and objects to support Government to fulfil its promise of providing ease of doing business to businesses and industries in the Country and help and support the taxpayers for smooth, correct and effective compliances under the direct and indirect tax laws.

Concerning the above subject, we wanted to draw your kind attention on the present situation of the pandemic, where all business community is needing solid support from Government and hence we on behalf of all honest taxpayers demanding the said extension.

Very well appreciated steps are been taken by the Government and Esteem members of GST Council by providing facility to apply for restoration of GST Number without concerning any time limit; this step considered as a blessing upon blessing upon the declaration of relief in late fees for the return defaulters. We were expecting that many of the taxpayers will join the mainstream using these two reliefs but these generous steps are not been utilize by many only because there is no extension in availing of Input Tax Credit is been declared for the previous periods. Hence, with this, we are requesting to look at the matter very personally and provide some extension for availing of Input Tax Credit for the FY 2017-18, 2018-19 & 2019-20 up to 31st December 2020. Your substantial relief many of taxpayers and will reduce the quantum of litigations.

Sir, to adding the other side of the coin; we would also be expecting the facility to add and/or rectify the Invoice or credit note details in GSTR1. It will also help the government to identify the claim of Input Tax Credit of taxpayers and will secure the Government revenue.

We thus will be grateful, if the extension in availing of Input Tax Credit for 2017-18, 2018-19 & 2019-20 & Annual Return i.e. GSTR-9 & 9C for the F.Y.2018-19 will be  granted up to 31st December 2020. Looking forward to your timely and generous anticipation in the matter.
