Advantage of Doing Business in State of Uttar Pradesh

The State of Uttar Pradesh (UP) of India seems to have covered a middle ground in the Ease of Doing Business Reforms as per the (Department of Industrial Policy and Promotion (DIPP’s) Doing Business Action Plan. The State has great potential for industrial development in terms of its abundant resources, availability of skilled and semi-skilled labour and huge consumer market. The State Government has been taking the right steps, leveraging upon its investment potential in order, to attract industries and provide them an enabling environment to set up new and expand existing industries. The state currently stands at the 14th position according to the EoDB (Ease of Doing Business) rankings of DIPP.

UP is the State with the highest population (16.4 percent of India’s population) and is the fourth largest State in terms of its geographical area (9 percent of country’s geographical area). The population of UP corresponds to the huge consumer market and thus, a great scope for economic activities in all sectors of the economy. Further, the State has abundant skilled labour, which is able to cater to various sectors. However, the economic growth of the State is more capital intensive than labour intensive.

Geographical & Location Advantage of State of Uttar Pradesh

The State is located in the northern part of India and borders Bihar in the east, Madhya Pradesh in the south, Rajasthan, Delhi and Haryana in the west and Uttrakhand in the north. State of Uttar Pradesh is covered from all sides but has good connectivity in terms of roads, railways and air to other parts of the country.

Moreover, UP is rich in natural wealth with abundant minerals, forests, flora and fauna. It is blessed with large tracts of agrarian fertile plains and a vast river network, bringing a scope for agro-based and food processing industries. The State is known for its mineral resources, such as limestone, dolomite, glass-sand, marble, bauxite, non-plastic fireclay and uranium. Also, UP is popularly known for its key traditional industries comprising handicrafts, leather goods, carpet, textiles, sugar, cotton yarn, jute, vegetable oil, glassware and bangles, cement, etc.

The Directorate of Infrastructure and Industrial Development is the State Department, which formulates and implements relevant policies and strategies for facilitating EoDB in the State. Udyog Bandhu on the other hand, is a three tier organization (at District level, Divisional level and State level) set up to facilitate investments in the State and resolve investor grievances.

When setting up a factory in Uttar Pradesh, the following documents are typically required for registration and obtaining various approvals. The documents required can vary slightly depending on the specific industry and the type of license/registration you are applying for. Here’s a list of common documents for the general factory setup process:

1. Factory License (Under the Factories Act, 1948)

  • Application Form (as prescribed by the state authority)
  • Proof of Ownership or Lease Agreement (for the factory premises)
  • Detailed Layout Plan of the Factory (showing the location of machines, workers, safety equipment, etc.)
  • List of Directors or Partners (if it’s a company, partnership, or LLP)
  • Worker Employment Details (e.g., list of employees or projected number of workers)
  • No Objection Certificate (NOC) from local authorities (municipal corporation, panchayat)
  • Fire Safety Certificate (if applicable)
  • Health and Safety Details (if relevant to the industry)
  • Environmental Compliance Certificate (if applicable)

2. GST Registration

  • PAN of the Business (company/partnership)
  • Aadhaar Card of the proprietor or authorized signatory
  • Proof of Business Address (e.g., lease agreement, utility bill, etc.)
  • Bank Account Details (including a canceled cheque)
  • Business Constitution Document (e.g., Partnership Deed, Certificate of Incorporation, or Memorandum of Association)
  • Photograph of the proprietor/authorized signatory

3. Permanent Account Number (PAN) and Tax Deduction Account Number (TAN)

  • PAN Card of the business (company/partnership)
  • Business Registration Certificate
  • Proof of Identity and Address (for the authorized signatory)
  • Proof of Address (for the office or factory premises)

4. Trade License

  • Application Form (from local municipal authorities)
  • Proof of Address (lease deed, property tax receipt, etc.)
  • ID Proof of the business owner (Aadhaar/PAN)
  • Partnership Deed (if applicable)
  • Certificate of Incorporation (if applicable)
  • Details of the Employees (if required)
  • Proof of Factory Setup (e.g., proof of machinery or premises)

5. Employee Provident Fund (EPF) Registration

  • Establishment Details (address, nature of business, etc.)
  • List of Employees (including names, positions, and salary details)
  • PAN of the Establishment
  • Aadhaar Card of the Proprietor/Partners/Directors
  • Bank Account Details

6. Employees’ State Insurance (ESI) Registration

  • Proof of Registration of Business (e.g., PAN, GST certificate)
  • List of Employees (with salary details)
  • Address Proof of the Factory
  • Details of Bank Account
  • Aadhaar Card of the authorized signatory
  • Employee Details (list of employees to be covered under ESI)

7. Environmental Clearance (if applicable)

  • Application for Environmental Clearance
  • Environmental Impact Assessment (EIA) Report
  • Project Report (detailing the processes, machinery, and raw materials)
  • Land Ownership Proof (Sale Deed/Lease Agreement)
  • No Objection Certificate (NOC) from local authorities
  • Pollution Control Measures (document outlining steps taken to control pollution)
  • Proof of Consent for Effluent Discharge (if applicable)

8. Fire Safety Clearance

  • Fire Safety Plan (prepared by a certified fire safety consultant)
  • No Objection Certificate (NOC) from the local fire department
  • Details of Fire Fighting Equipment (types, locations, and certifications)
  • Training Records (for staff on fire safety measures)
  • Layout Plan showing fire exits, fire safety equipment, etc.

9. Shops and Establishment Act Registration

  • Application Form (available from the state labor department)
  • Proof of Ownership or Lease Agreement
  • Photographs of the Premises
  • Identity Proof (Aadhaar/PAN) of the owner
  • Details of Employees (name, position, and salary)
  • Trade License (if required by local authorities)

10. Hazardous Waste Authorization (if applicable)

  • Application Form for hazardous waste authorization
  • Details of Hazardous Substances (handled in the factory)
  • Environmental Impact Report (if required)
  • List of Pollution Control Measures
  • Consent to Operate (from Pollution Control Board)
  • Details of Waste Disposal System

11. Drug Manufacturing License (for Pharmaceutical Industry)

  • Application Form (from the Drugs Controller, Uttar Pradesh)
  • List of Products to be manufactured
  • Drug Manufacturing Facility Layout (with a description of machinery and processes)
  • Certificate of Incorporation
  • Details of Manufacturing Team (including technical staff qualifications)

12. FSSAI Registration (Food Industry)
