Nipun Praveen Singhvi Vs National Company Law Tribunal (Gujarat High Court)

In a recent development, the Gujarat High Court has directed the National Company Law Tribunal (NCLT) in Ahmedabad to permit the use of electronic devices such as laptops, tablets, and notebooks during court hearings. This ruling comes in response to a petition filed by Nipun Praveen Singhvi against the NCLT.

During the hearing, Mr. Percy Kavina, the senior counsel representing the petitioner, argued for the court to invoke Article 226 of the Indian Constitution, urging the allowance of electronic devices in line with directives set by the Supreme Court. The petitioner highlighted a notice posted by NCLT Bench No. 2, prohibiting the use of mobile phones and other electronic devices within the courtroom.

The High Court acknowledged the importance of technology in facilitating access to justice, citing a previous Supreme Court order emphasizing the necessity of technological integration in legal proceedings. Quoting from the Supreme Court’s order, the High Court emphasized that restricting access to technology hampers efficiency and sends a negative message about access to justice.

In light of these considerations, the High Court directed NCLT Ahmedabad to modify its notice, allowing for reasonable restrictions that do not disrupt court proceedings. The court underscored the need for a technologically adept environment for both legal practitioners and litigants. Additionally, the High Court noted that the petitioner had been accustomed to making arguments via electronic devices due to the prevalent e-filing system.
