FOOD SAFETY AND STANDARDS AUTHORITY OF INDIA

NOTIFICATION

New Delhi, the 8th March, 2021

No. Stds/SP-15/T[T(IMST)].Whereas the draft of certain regulations further to amend the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011, was published as required by sub-section (1) of section 92 of Food Safety and Standards Act, 2006 (34 of 200), vide notification of the Food Safety and Standards Authority of India number Stds/SP-15/T[T(IMST)], dated the 10th November, 2020, in the Gazette of India, Extraordinary, Part III, Section 4, inviting objections and suggestions from the persons likely to be affected thereby, before the expiry of the period of sixty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public;

And whereas the copies of the said Official Gazette were made available to the public on the 18th November, 2020;

And whereas the objections and suggestions received from the public in respect of the said draft regulations have been considered by the Food Safety and Standards Authority of India;

Now, therefore, in exercise of the powers conferred by section 92 of the said Act, the Food Safety and Standards Authority of India hereby makes the following regulations further to amend the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011, namely: –

Regulations

1. (1) These regulations may be called the Food Safety and Standards (Prohibition and Restrictions on Sales) Third Amendment Regulations, 2021.

(2) They shall come into force on 8th June, 2021.

2. In the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011,-

(A) in regulation 2.1 relating to ―Sale of certain admixtures prohibited”, in sub-regulation 2.1.1, after clause (10) the following clause shall be inserted, namely: –

“(11) Any Multi source edible vegetable oil containing Mustard Oil manufactured on or after 8th June, 2021.”

(B) in regulation 2.3 relating to ―Prohibition and Restriction on sale of certain products”, in sub-regulation 2.3.14, for clause (11), the following shall be substituted, namely: –

“(11) The Multi Source Edible Vegetable Oil shall not be sold in loose form. It shall be sold in sealed package weighing not more than 15 Kilograms. The container having Multi Source Edible Vegetable Oil shall be tamper proof. It shall also not be sold under the common or generic name of the oil used in the blend but shall be sold as – Multi Source Edible Vegetable Oil. The sealed package shall be sold or offered for sale only under AGMARK certification mark bearing the label declarations as provided in the Regulations besides other labelling requirements under the Regulation.”

(iii) No. Stds/F&VP/Notification (02)/FSSAI-2016, dated the 23rd August, 2016;

(iv) No. Stds/O&F/Notification (8)/FSSAI-2017, dated the 31st July, 2018;

(v) No. Stds/Additive-3/notification/FSSAI/2018, dated the 21st July, 2020; and

(vi) No. Stds/O&F/Notification(13)/FSSAI-2019, dated the 2nd February, 2021.
