However, in cases where the application for obtaining credit is filed after realisation of export proceeds, such application may be filed within 90 days from the date of realisation or 180 days from the date of exports whichever is later, reckoned from the last date of realisation/exports in respect of shipments for which the claim has been filed.
In exercise of powers conferred under section 5 of the Foreign Trade (Development and Regulation) Act, 1992 read with paragraph 1.3 and 4.1 of the Export and Import Policy, 1997-2002, the Central Government hereby makes the following amendments in the ITC(HS) Classifications of Export and Import Items, 1997-2002 publishedon 31st March, 1997 (RE-98) as amended from time to time, namely.
References have been received with regard to consideration of an application within the prescribed time limit. It has been observed that the licensing authorities are following different practices while considering whether a particular application has been submitted in time or not. It is clarified that wherever the application has been submitted alongwith the prescribed documents as mentioned in the Handbook (Vol.1) for such category of application in time, such applications shall be treated as a complete application which is submitted in time though there may be some deficiencies in the application or documents.
Attention is invited to Paragraph 7.8 of the Export and Import Policy 1997-2002, as amended and Paragraphs 7.8 and 7.10 of the Handbook of Procedures, Vol.1, 1997-2002, as amended and also to the Handbook of Procedures, Vol.2, 1997-2002, as amended from time to time.

Cases where EPCG Committees took a decision to grant second hand EPCG licences before 31-3-1999 but licence could not be issued. In such cases, applicants shall have the option of converting their EPCG applications into restricted import licence applications and for that they may submit only a revised application in Appendix 8 of the Handbook of Procedures.
