Sub: Extension of Due date of Income Tax Returns and Tax Audit pursuant to system glitches

This is to request your good self to go through this representation and Please Extend Due Dates of Income Tax for Non Audit as well as Audit cases, Tax Audit Report Submission dates.

System & Technical Glitches on Income tax Portal

1) Since 7-6-2021 Tax payers & professionals are struggling because of Glitches on New Income tax portal.

A) Most of the offline utilities of income tax return provided either at the end of June 2022 or version modified from time to time till June 2022 even though form of ITR were notified much in advanced. Till date utilities of ITR-5,6,7 & 8 are not provided properly and shows errors while uploading Return of Income Tax. As per hon’ble Bombay High Court’s Judgement all offline utilities and form should be provided on 1st April each year.

B) Annual Information statements could not be downloaded since Last 2 Days. Annual information Statements are updated every day and Additional information are provided. In such scenario Assessee have no option but to wait till all data are provided properly populated in Annual information Statement.

C) In Form No.16 Bifurcation of Salary is not provided while Return of Income provides different Rows Like Basic Salary, House Rent Allowance, Leave Travel Allowance etc. Tax Payers has to wait for all information and once all information is available then only True and Correct Return of income can be uploaded.

D) When some entries are there in Form 26AS but those entries are missing in Annual Information Statement. This creates confusion in the mind of Tax Payers and Professionals.

E) Digital Signature registration takes lot of the time. Beginning Problem is still not sorted out fully.

F) Login to Income tax Portal is a big trouble. Most of the Tax Payers and Professionals are facing difficulties. This Fact is also accepted by Infosys in their statement in June end by saying unusual web Traffic.

G) When Grievances are made Stereo type replies are received and closing Grievance.

H) Facility to Login as Legal Heir or Representative Assessee is taking unusually long time. Because of which Legal heir are not in position to Upload return of income of Deceased person.

I) System of Accounting is not clarified in Return of income & Annual information statement. Though Refund is determined but not received on or before 31-03.2022 till AIS shows interest on income tax Refund, Dividend though declared but not received before 31.03.2022 are shown in AIS.

J) Some of Twees shows that only 734 returns are uploaded in one day throughout the India recently and AIS showing share transactions of Dec 2022. It clearly indicates Glitches of New Income tax Portal.

K) Issue of Refund in the name of Legal Heir is still not started though that option is provided while Request for Reissue of Refund is raised. This difficulty faced more so in the case of non-residents.

2) Other multiple Compliances for the business in July to September Month

A) TDS Returns for April to June Quarter-1 has to be uploaded on or before 31.07.22 TDS Payments are to be done Every month Before 7th of month.

B) Advance Tax Needs to be worked out and paid on or before 15.09.2022.

C) GST Compliances are to be done every month. QRMP on or before 22.nd of each month, GSTR 1 has to be uploaded on or before every 11th of the Month. IFF , GSTR 3B to be Uploaded on or before 20th every Month.PMT-06 has to be uploaded on or before 25th each month. All this forms required lot of workings which takes lot of time.

D) MCA has launched new portal V3 for LLP. Portal had various technological challenges and LLPs were struggling to file forms on new LLP-MCA portal. Till date challenges are being faced.

3) Natural Calamities

A) Heavy Rain throughout The India.

B) Covid 19 cases increasing Every Day,

C) Monkey Pox cases are found in Kerala and it is creating threat in the minds of people

D) Experts are predicting wave of covid19 and monkey pox.

4) Income tax Act provides for 4 months from the date of providing ITR forms/ utilities in case of Non Audit cases & 6 months for Audit cases. For A Y 2022-23 offline utilities are Provided only at the end of June 2022. Hence if we count 4 months from June due date for Non audit cases should be 31.10.2022 and For Tax Audit Report should be 31.12.2022.

Request to Extend Due date of Income Tax Returns and Tax Audit

As Infosys & Income tax department fails to provide forms & Utilities on 1st April 22 All Due dates of Income tax return & Tax Audit Report to be extended by 3 months, otherwise it will amount to contempt of Court.

5) Working of Capital Gain on shares takes too much time as various details are to be provided in Return of income including ISIN code number of the Company.

6) If dates not extended than Quality of Audit Report will be compromised And Tax Audit Reports will be of no use to department.

Considering all above points I am sure you will extend immediately helping hand to Tax payers & Professionals before it is too late. Once again request on behalf of tax payers and Professionals to Extend All due dates by 3 months including that of Registration of company forms.
