Public Notice No. 20 (RE-03)/2002-2007 outlines amendments in the Export and Import Policy 2002-2007 for engineering product standards and input-output norms.
Duty free imports of goods as specified in list 28A of Customs notification No. 21/2002 dated 1.3.2002, (as amended from time to time) upto 1% of the FOB value of exports made during the preceding licensing year, shall be allowed to agro chemicals sector unit having export turnover of Rs. 20 crore or above during preceding licensing year. Such facility shall be available only to a manufacturer having a research and development wing registered with Deptt. of Scientific and Industrial Research in Ministry of Science and Technology subject to fulfilment of condition no.53A of the said notification.
Import allowed through IOC, subject to para-2.11 of the Exim Policy, except for the companies who have been granted rights for marketing of transportation fuels in terms of Min. of P&NG’s Resolution No.23015/1/2001-MKT dated 8.3.2002 including HPCL, BPCL & IBP who have been marketing transportation fuels before this date.

A consignment / lot is considered to be undersized if it contains the following species any piece of which has a weight less than that specified below against the species or has been processed out of or obtained from individual pieces of the following species weighing less than the minimum weight against the species.
In case an EOU/EHTP/STP unit is unable, for valid reasons, to utilize the goods and services, imported or procured from DTA, it may be transferred to other EOU/SEZ/EHTP/STP units or disposed off in the DTA with the approval of the Development Commissioner on payment of applicable duties and submission of import licence by DTA unit, wherever applicable or exported. Such transfer of imported goods and services from EOU/EHTP/STP unit to another such unit would be treated as import for the receiving unit.
These ad-hoc rates would be notified in the form of Public Notice and all the exporters utilising the ad-hoc DEPB rates would be required to furnish actual data of exports indicating Shipping Bills No., quantity and fob value of export actually made under DEPB within 4 months from the date of fixation of ad-hoc DEPB rates to enable this office to convert the ad-hoc the DEPB rates into permanent DEPB rates.

This office has come across cases wherein firms desirous of commencing production by availing of an EPCG licence have been unable to do so on account of non furnishing of Registration Cum Membership Certificate (RCMC) as a manufacturer exporter from the Export Promotion Councils. The Councils have been unable to issue such an RCMC on account of the unit not having commenced production and thus having only a provisional registration number (whether SSI or any other).
