Securities and Exchange Board of India (SEBI) has issued the Securities and Exchange Board of India (Credit Rating Agencies) (Amendment) Regulations, 2024. These regulations, effective from their publication in the Official Gazette, amend the existing Securities and Exchange Board of India (Credit Rating Agencies) Regulations, 1999. Specifically, regulation 28B(1)(d)(i) now defines “liquid asset” to include assets such as cash, overnight or liquid mutual fund units, fixed deposits in scheduled commercial banks, government securities, treasury bills, and repo on government and corporate bonds. These amendments aim to enhance clarity and include more specific categories under the definition of “liquid asset,” ensuring a more precise regulatory framework for credit rating agencies operating under SEBI’s oversight.

SECURITIES AND EXCHANGE BOARD OF INDIA (CREDIT RATING AGENCIES) (AMENDMENT) REGULATIONS, 2024

No. SEBI/LAD-NRO/GN/2024/191 —In exercise of the powers conferred under section 30 read with section 11 of the Securities and Exchange Board of India Act, 1992 (15 of 1992), the Board hereby makes the following regulations to further amend the Securities and Exchange Board of India (Credit Rating Agencies) Regulations, 1999, namely: –

1. These regulations may be called the Securities and Exchange Board of India (Credit Rating Agencies) (Amendment) Regulations, 2024.

2. They shall come into force on the date of their publication in the Official Gazette.

3. In the Securities and Exchange Board of India (Credit Rating Agencies) Regulations, 1999,

(1) In regulation 28B, in sub-regulation (1), in clause (d), in the Explanation, clause (i) shall be substituted with the following, namely,-

“(i) “liquid asset” means a low risk asset such as cash, units of overnight or liquid mutual fund schemes, fixed deposits of scheduled commercial banks, government securities, treasury bills, repo on government securities and repo on corporate bonds that may be easily converted into cash in a short period of time.”
