ICAI has sent a Humble reminder to FM to for immediate consideration of their   request(s) for extension of various due dates under Income-tax Act, 1961 especially Tax Audit Reports and related returns and Income Tax Return Forms for AY 2020-21. ICAI has also made an representation earlier on 13th December 2020. Full text of the current representation is as Below-

Re: Humble reminder to consider immediately our request(s) for extension of various due dates under Income-tax Act, 1961 especially Tax Audit Reports and related returns and Income Tax Return Forms for AY 2020-21

We refer to our earlier representation (ICAI/DTC/2020-21/Rep – 26 dated 13.12.2020) submitted to your good office detailing therein issues/concerns being faced by taxpayers/members due to ongoing COVID19 pandemic and the resultant need to further extend the due date of filing ITR Forms and Tax Audit report and other related returns/reports for AY 2020-21. It is reported that Income tax website has slowed down.

Urgent need to decide extension of due dates especially of ITR Forms and TAR for AY 2020-21 in the interest of assessees and professionals-Income tax website has slowed down

In this hyper atmosphere of pandemic, health of professionals as well as assessees is at risk and is highly vulnerable. Extensions of due dates of compliances for this year is highly justified and will do good both for revenue as well as assessees and professionals concerned.

It is also pertinent to mention that our members as well as assessees have reported that the official website of income-tax department (efiling) is having issues recently and has slowed down considerably may be due to online voluminous traffic. This has further added tensions and pressures to the already burdened assessees as well as professionals.

Suggestion(s):

In the interest of the Nation as a whole, it is once again humbly requested that the CBDT may decide on an immediate basis to extend due date of filing return of income u/s 139(1) as well as tax audit report and related returns for AY 2020-21 to a suitable date of say 31.03.2021 from 31.12.2020 which is fast approaching. Further, all the other due dates of compliances under Income-tax Act, 1961 (TDS/TCS/Section 11(1A)/54/54F/Advance tax payments etc.) be suitably extended to say 31.03.2021 to enable assessees to meet such deadlines without incurring any other extra cost.

We hope that our suggestions would be favourably considered. We would be happy to deliberate on the matter albeit virtually, if considered necessary by your good office.

    IF DEPARTMENT CAN’T MAKE READY ALL RETURNS ON DATE 1ST APRIL, THEY HAS NO RIGHT TO FORCE TAX PAYER AND PROFESSIONALS TO OBEY ANY LAST DATE FIXED FOR ANY RULES.

    It’s fact that due to loose of man power effected by COVID-19 loss due to died CA a firm died also employee and also work hamper by Covid-19 due to transportation and comunication.

    So extended date died line would be 31st March’2020, I and all employee reach to office earlier and left from office late approx 8-9 p.m. but impossible that one day more than 10 return uploded due to server slow,.

    Yes it true trouble is being faced on ITR filing on income tax department CPC site taking longer than usual and professional are awaited to return the ITR . I am trying to get fill return asking form16 But not received yet.
    Hence I am worried.

    Why the request? Not extending the due dates is a
    Contempt of Supreme Court and Delhi High Court.

    The Supreme Court of India by its order dated 23-03-2020 Suo Moto took cognizance for extension of limitation and ordered that due to Covid-19 difficulties, all limitations under the general law or Special Laws whether condonable or not shall stand extended w.e.f. 15th March 2020 till further order/s to be passed by this Court in present proceedings.(Including Income Tax Act & GST Act). The SC again reaffirmed this order on 19-12-20 stating that the said order is still operative and by subsequent orders, the scope has been enlarged so that the said order applies in other proceedings also
    .
    Similarly, the DELHI HIGH COURT [2015] 378 ITR 137 (Del) 21-09-15 ordered that there appeared to be no justification for delay beyond the assessment year in prescribing the ITR forms and the department is directed to at least ensure that the prescribed forms are available as on 1st April of the assessment year itself unless there is a valid reason therefor and which should be recorded in writing by the department without waiting for any representations to be made.

    The department has already conveniently extended its own due-date-limitations for many proceedings like reopening of assessment proceedings, completion of time barring assessment proceedings, issue of various notices etc. Why not same treatment to the assessees.?

    The Finance Minister is thus causing contempt of court by bluntly disobeying these orders by closing the due dates which have been kept open by the SC by its still operative order and by not webcasting the ITR etc. forms on 1st April 2020 as per the order of the Delhi High Court. As per the order of the Delhi HC minimum 180 days, from the date the forms were released/ updated on the website, must be provided to the assessees for compliance.Form 3CA-CD/3CB-CD were updated only on 04-11-20, 180 days from that will be 03-05-21. But we are asking only upto 31-03-21.

    Please consider the extension mam here one person with pressure got heart attack and many are suffering with covid and some working with newly cured from covid we cant pressure them to do as clients are coming now to submit huge bank statements…try to understand MADAM RIP GOVERNEMENT.

    No one requested for extending of FY 18-19 due dates but when every one in majority is requesting for FY 19-20 due dates extension plea is not heard by learned people intentionally, wondering will there be a silver lining for the efforts and concerns expressed or efforts just washed off in vain.

    Please Extend due date, as from staff members many members got Covid Positive. As much work is pending to do and presently very much work pressure is felling, as clients has not provided documents early now due to email received, they are hurrying up. Please understand the situation for our professional people. We are not doing proper work due to this pressurized situation, Please kindly consider this matter and extend the due date for filling ITR for AY 2020-21 and Audit fory AY 2020-21. This is in the interest of Nation. Thank You

    Since attitude of the Government’s first priority is collections (tax)/revenue, by giving relaxation by way of extending the deadlines, may look into the aspect of directing the tax payers to remit the tax at certain percentage say 1% or 0.5% or so by the end of Jan.21 as self-assessment tax. Of course, in this way, Government will lose interest on self-assessment tax when paid at the time of filing of return. But now it will get immediate revenue which need not be postponed till the extended date.

    A wiseman/gentleman needs a word to correct or say a thing and an animal needs one simple hit to move/ On the other hand, if it needs more, what to say ??? I leave to it to your discretion. In Telugu/Kannada Language, they say Jada Bharatha. So is the present issue related to extension of time to submit the returns and reports

    This is horrible that Government of the day is NOT listening to more than 50 representation submitted for extension. It looks like Tax payers have no respect in this country
