The Directorate General of Foreign Trade issued Notification No. 37 (RE-2005)/2004-2009 on January 9, 2006, under Section 5 of the Foreign Trade (Development and Regulation) Act, 1992, and Paragraph 2.1 of the Foreign Trade Policy 2004-09. The notification amends the ITC(HS) Classifications of Export and Import Items. It updates the import policies for certain electronic items, including cellular phones and radio communication equipment. Import of fixed wireless phones is now free, while radio communication equipment, such as VHF and UHF devices, requires a license from the Wireless Planning and Coordination (WPC) wing of the Ministry of Communications and Information Technology. Additionally, Import Licensing Note No. 1 of Chapter 85 has been deleted, and references to the “Ministry of Communication” in certain Exim Codes have been updated to reflect the full name of the Ministry of Communications and Information Technology. These changes aim to streamline import regulations and align terminology with current standards. The notification is issued in public interest.

NEW DELHI, DATED 9th January, 2006

S.O. (E) In exercise of powers conferred by Section 5 of the Foreign Trade (Development and Regulation) Act, 1992 read with paragraph 2.1 of the Foreign Trade Policy – 2004-09, the Central Government hereby amends the ITC(HS) Classifications of Export and Import Items, 2004-09 as under:

1. The Import Policy of the following items shall be amended to read as follows:

Exim Code Item Description Policy Policy Conditions
8525 20 17 Cellular telephone Free Import of Fixed wireless Phones is free.
8525 20 19 Other Free Radio communication equipment including VHF, UHF and microwave communication equipment not permitted to be imported except against a licence to be issued by the WPC wing of Ministry of Communications and Information Technology.
8525 20 99 Other Free Not permitted to be imported except against a licence to be issued by the WPC wing of Ministry of Communications and Information Technology.

2. The Import Licensing Notes No. (1) of Chapter 85 to Schedule – 1 (Imports) stands deleted.

3. The words “Ministry of Communication” appearing in Column-4 against Exim Codes – 85251010, 85251020, 85252015 and 85252092 of ITC(HS) Classifications of Export and Import Items, 2004-09 shall be amended to read as “Ministry of Communications and Information Technology”.

4. This issues in public interest.
