Sub: – Import policy of items classified under ITC (HS) Code 2846 (Compounds, in-organic or organic, of rare-earth metals, of yttrium or of scandium or of mixtures of these metals)
Vide Notification No. 90 (RE- 2007) dated 28-03-2008, import of items classified under ITC (HS) Code 2846 (Compounds, in-organic or organic, of rare-earth metals, of yttrium or of scandium or of mixtures of these metals) have made ‘Free’. Representations have been received in this office seeking clarification regarding the effective date for free importability of these items.
2. The matter has been examined. Notification No.90 (RE- 2007) dated 28-03-2008, has been issued based on recommendation received from Department of Atomic Energy, Government. Department Atomic Energy has recommended these changes in the import Policy, in accordance with Notification dated 18.01.2006, issued by them under Atomic Energy Act, 1962. As per the Notification, items under ITC (HS) Code No. 2846 ceased to be “Prescribed Substances” with effect from 01.01.2007.
3. In view of the difficulties expressed by trade and industry, as a special case, it is clarified that, import of items classified under ITC (HS) Code 2846 (Compounds, in-organic or organic, of rare-earth metals, of yttrium or of scandium or of mixtures of these metals) shall be considered ‘Free’, retrospectively with effect from 01.01.2007.
This issues with the approval of competent authority.
