MCA has vide General Circular N0. 27/2014-  Dated 30.06.2014 extended the  due date for Filing DPT-4 with Registrar of Companies in respect of Deposits standing on 01.04.2014 i.e. the date of Commencement of Companies Act, 2013  from 30.06.2014 to 30.08.2014 without any additional fee. Related Notification is as follows :-

Sub: – Clarification regarding filing of Form DPT4 under Companies Act, 2013.

This Ministry has received reference regarding filing of Form DPT4 under the provisions of the Companies Act, 2013. As per section 74(1)(a) of the Companies Act, 2013and the companies (Acceptance of Deposits) Rules, 2014 made there under, companies are required to file a statement regarding deposits existing as on date of commencement of the Act within a period of 3 months from such commencement. The time for filing of said statement is expiring on 30-06-2014.

2. After considering the reference, it has been decided to grant extension of time for the period of 2 months i.e. up to 31-08-2014 without any additional fee in terms of section 403 of the Act to enable the companies for filing of statement under Form DPT4 with the Registrar.

    Due date has been extended for filing DPT-4 till, 31st August, 14.
    Even today MCA is charging 4 times additional Penalty.
    what is the solution?

    I fail to understand how the MCA can extend the date when there is no power given to it under section 74.

    The section speaks about unpaid deposits which became due for repayment.

    No need to file any return if there is no unpaid deposit.

    I agree this is no law and need to be scrapped as early as possible.

    The problem is that there is no one to represent the private companies.

    Someone should bring a PIL in the Supreme Court/ High Court or the courts should take up it suo motu.

    Though Due date has been extended for filing DPT-4 till, 31st August, 14, MCA is charging 4 times additional Penalty on 18.08.2014. ROC site has still not been updated or what? Anyone has filed DPT-4 after 30.06.2104. Pls Help.

    The reason : most of the private companies might have shown protests by ignoring to file DPT 4. Earlier government enacted an unconstitutional and draconian provision prohibiting even private companies to accept loans from director’s relatives and shareholders. Government should wake up and put things right restoring earlier situation in respects of acceptance of Loans by private companies.
