The Government has said that it is aware that several unqualified persons are using false registration numbers and issuing fake certificates by pretending to be Chartered Accountants. Ninety four cases of fake certificates since April, 2006 have come to the notice of the Institute of Chartered Accountants of India. These include issue of false certificates with fake name, registration number (membership number) address etc.

Giving this information in the Lok Sabha in a written reply Shri Salman Khurshid, Minister for Corporate Affairs, said that ICAI is empowered under Chartered Accountants Act, 1949 to deal with such issues. Recognizing the fact that such instances are on the increase, section 26 of the said Act was amended in 2006, by the Chartered Accountants (Amendment) Act, 2006, whereby the offence has been made punishable on the first conviction with a fine of not less than Rs.5,000/- but which may extend to Rs.1 lakh and in the event of second or subsequent conviction, with imprisonment for a term, which may extend to one year or with fine not less than Rs.10,000/- but which may extend to Rs.2 lakhs or with both.

    IF THE HUGE TAX AUDIT HAS BEEN CONDUCTED BY FAKE CA FROM 1999 AND HE SO MANY TIMES APPEARED IN INCOME TAX DEPARTMENT AS CA WHAT WILL INCOME TAX DEAL WITH THE EFECTED PARTIES

    I do agree with Mr. Govind Gupta on the issue of semi qualified C.A.The regulating authority must take some steps in order to recognise those who have completed their three year training and have good exposure in the area of Accounting profession.

    there is a fake ca in howrah who teaches ca students, uses some other persons membership no and do attestation of ca students, unfortunately many students dont know he is not a ca and he teaches very wrong things to ca students icai should take steps, whom to complain dont know

    There should be some arrangement in the constitution for those who are semi qualified before 1995, who has spent much time in profession and having enough knowledge about subject metter/matters.
    some arrangement in constitution may help those who have completed 3 years of Article clerck or 10 years in the said profession with C.A. this may reduce the fradulant excersice of using the false ICAI registration no.

    If the given point properly cared in constitution than it will create the new Job for people of india and fraud can be minimised to nil.
