“Credit Card, Debit Card, Charge Card or Other Payment Card Service” includes any service provided,— (i) by a banking company, financial institution including non-banking financial company or any other person (hereinafter referred to as the issuing bank), issuing such card to a card holder; (ii) by any person to an issuing bank in relation to such card business, including receipt and processing of application, transfer of embossing data to issuing bank’s personalisation agency, automated teller machine personal identification number generation, renewal or replacement of card, change of address, enhancement of credit limit, payment updation and statement generation; (iii) by any person, including an issuing bank and an acquiring bank, to any other person in relation to settlement of any amount transacted through such card.
Courier Services-Courier Agency means a any person engaged in the door-to-door transportation of time –sensitive documents, goods or articles utilising the services of a person, either directly or indirectly, to carry or accompany such documents, goods or articles.
Cost accountant’s services means any service provided or to be provided [to any person], by a practicing cost accountant in his professional capacity, in any manner; “Practicing Cost Accountant” means a person who is member of the Institute of Cost and Works Accountants of India and is holding a certificate of practice granted under the provisions of the Cost and works Accountants Act, 1959 (23 of 1959) and includes any concern engaged in rendering services in the field of cost accountancy;
Cosmetic or Plastic Surgery Service means any service provided or to be provided to any person, by any other person, in relation to cosmetic surgery or plastic surgery, but does not include any surgery undertaken to restore or reconstruct anatomy or functions of body affected due to congenital defects, developmental abnormalities, degenerative diseases, injury or trauma.
Amid concerns by medical community on the proposed service tax on healthcare, Finance Minister Pranab Mukherjee today said in the Rajya Sabha that he would respond to the representations on tax issues next week.Following the reply of Mukherjee on general discussion on the Budget, the Rajya Sabha returned the Appropriations Bills, completing the first phase of the three-stage exercise for passage of the budget.
Convention services means any service provided or to be provided [to any person], by any person in relation to holding of convention, in any manner; Convention” means a formal meeting or assembly which is not open to the general public, and dose not include a meeting or assembly the principal purpose of which is to provide any type of amusement, entertainment or recreation;
consulting engineer’s service means any service provided or to be provided to any person, by a consulting engineer in relation to advice, consultancy or technical assistance in any manner in one or more disciplines of engineering including the discipline of computer hardware engineering but excluding the discipline of computer software engineering”
Copyright Services means any service provided or to be provided to any person, by any other person, for – (a) Transferring temporarily; or (ii) Permitting the use or enjoyment of, Any copyright defined in the Copyright Act, 1957 (14 of 197), except the rights covered under sub-clause (a) of clause (1) of section 13 of the said Act.
The Union Health Ministry has urged Finance Minister Pranab Mukherjee to roll back five per cent service tax imposed on hospitals and diagnostic centres in this year’s budget, arguing that it would make health care more expensive for the poor.
I note that in the case of Commissioner of Central Excise, Nagpur Vs Ultra Cement Ltd. = ( 2010-TIOL-745-HC-MUM-ST ) , the Nagpur Bench of Hon’ble Bombay High Court has held that credit of service tax would be allowed except where the cost of food has been recovered from the employee/worker. Although, ld. counsel submits that a token amount of Re.1/- has been collected from the employees/workers of the assessee’s company, since show cause notice does not advert to this factual position nor do the orders of the authorities below consider this aspect, the impugned order is set aside and the case remitted to the adjudicating authority for fresh decision in the light of the Hon’ble High Court judgment cited supra.
