B M Sharma new ICWAI prez, M Gopalakrishnan elected VP. The Institute of Cost and Works Accountants of India (ICWAI) today said that B M Sharma has been elected as its president for the year 2010-2011. Sharma, who replaces G N Venkataraman, was earlier the vice president of the cost accounting regulator, it said in a statement.

Reference has been received from the Trade that divergent practices are being followed by field formations regarding classification of ‘Aseptic packaging paper’. It has been reported that even when the aseptic packing paper is coated, impregnated or covered with plastics, such products are being classified under the Tariff Item 4811 90 92, as specific description ‘Aseptic packaging paper’ is provided there.

V/s CCE, Raipur [2010-TIOL-624-CESTAT-DEL-LB] delivered on 30.04.10, on admissibility of credit on capital goods and inputs and to state that the Tribunal has ruled that ‘capital goods’ defined in the CENVAT Credit Rules, in the context of providing credit of duty paid, have to be excisable goods.

Calling it the biggest litigant in the entire Government, Finance Minister Pranab Mukherjee has asked the Income Tax Department to reexamine the way it handles tax disputes. He said, the Department is filing appeals in a routine manner without careful thought and examination leading to the Income Tax Department earning the dubious distinction of being the biggest litigant in the Government of India.
