Application for registration of contracts for export of raw cotton would be submitted to the 7 designated RAs namely: -Ahmadabad, CLA, New Delhi, Bangalore, Kolkata, Hyderabad, Chennai and Mumbai. To streamline the process of registration the following procedure would be adopted in addition to those provided in the Notification No.113 of 4th May 2012.
A detailed step by step guide for filling the online SCOMET application is available on the DGFT website (dgft.gov.in) under the ‘Help’ option. A link for ‘SCOMET Help’ guide has also been provided at the end of the ‘Guidelines’ given below. Exporters are encouraged to file ANF 2E applications online. Exporters will have the option to apply for SCOMET licence either by submitting a paper application to the DGFT(Hqrs.), Udyog Bhawan, New Delhi or by filing application online. This facility of applying either by a hard copy or online will cease on 30.06.2012.
Trade Notice 25 Facility for online filing of Aayat Niryat Form 2E (application form for SCOMET Licence) is being introduced by DGFT to reduce time and transaction cost for the exporters and facilitate faster processing of SCOMET applications. Online SCOMET application can be accessed on the DGFT website under the icon ‘ECOM Application’.
Trade Notice 24 dated 20th March, 2012 Through Public Notice No. 102 dated 16.03.2012 procedure for scrutiny and revalidation of Registration Certificates(RCs) for export of cotton were notified. Last date stipulated in this Public Notice for submission of applications for revalidation of RCs with the concerned RAs is Thursday, 22nd March, 2012. It is expected that the trade would have taken expeditious action for submitting the applications.

To facilitate the trade, STC number/Registrations were issued to those assessees also who were not having PAN Numbers. To them registrations were given by creating TEMP (Temporary) Numbers by the department. This was done so that genuine tax payers will be able to pay their tax on time. These assessees were required to subsequently obtain PAN Number from Income Tax authorities and apply to the department to convert Temp based Registration Number into PAN based Registration Number. As per the provisions of Section 69 of Chapter V of the Finance Act, 1994 and Rule 4 of Service Tax Rules, 1994 every person liable for paying the Service Tax shall make an application to the concerned jurisdictional Superintendent in Form ST-1 for registration and the same will be granted, after due verification, by the authorized officer, a certificate of registration in Form ST-2. 2. As per instructions issued vide CBEC Circular No. 493/59/99-CX dated 12-11-1999, 35/3/2001-CX.4 dated 27-08-2001 and 97/8/2007-ST dated 23-08-2007 Registration No. also known as ‘Service Tax Code’ (STC) will be alphanumeric fifteen digit PAN based number. The first part would be the 10 Character PAN issued by Income Tax authorities. It is mandatory for all the concerned persons registered under the rules to obtain PAN whether or not they pay Income Tax.
Attention is drawn to the Hon’ble Supreme Court’s order dated 14.10.2011 in the matter of Civil Appeal No. 8391-8393 of 2011 arising out of Bombay High Court’s order in Writ Petition No. 1474 of 2010 before Hon’ble High Court of Bombay challenging provisions of Section 65 (90a) read with Section 65 (105)(zzzz) of the Finance Act, 1994 as amended by Section 75 and 76 of the finance Act, 2010, which levied service tax on “Renting/leasing of immovable property” from 01.06.2007 which provisions were upheld by the Hon’ble High Court of Bombay by order dated 04.08.2011 and dismissed the Writ Petition No. 1474 of 2010. (Copy of Supreme Court Order dated 14/10/2011 enclosed).
This is in continuation of this office Trade Notice No. 17 dated 23.8.2011. All Export Promotion Councils / Commodity Boards / Authorities were requested that the registration process and uploading of RCMC data thereafter may be completed by 31.10.2011. If EPC’s /Commodity Boards /Authorities fail to register and upload data on DGFT’s website within the prescribed time limit as stated above, the ’on-line’ registration of RCMC issued by EPC’s /Commodity Boards /Authorities on DGFT’s website would be made mandatory w.e.f. 1.11.2011, after which no manual copy of RCMC / Registration Certificate will be entertained by DGFT offices.
Attention is invited to Trade Notice No. 15 dated 10.08.2011 through which 117 firms were declared defaulters in export of cotton in terms of Policy Circular No. 09 dated 29.12.2010 read with Trade Notice No. 11 of 29.06.2011. In Trade Notice No. 15 dated 10.08.2011 (para 3) it was provided that the exporters whose name appear in the Annexure-1 of this Trade Notice may approach the concerned RC issuing authority within 15 days along with all necessary documents for re-verification of documents. Para 4 of this Trade Notice provided that exporters can get their names removed from the list by paying penalty with the concerned RAs.
