In terms of the provision of para 8.2 (f) of the Exim Policy 2002-07, the benefits of deemed exports under para 8.3 (a), (b), and (c) whichever is applicable , would be available for the supply of Cupro Nickel Coin Blanks to a Mint of the Government of India, provided the goods are manufactured in India and subject to the fulfilment of condition No 26 against S.No 191 of Customs Notification No 21/2002 dated 01.03.2002.
In exercise of powers conferred under Paragraph 2.4 of the Export and Import Policy, 2002-2007 and Paragraph 1.1 of Handbook of procedures, (Vol.1) , 2002-2007, the Director General of Foreign Trade hereby makes the following amendments in the Public Notice No.38 (RE-99)/1997-2002 dated 5.11.1999 vide which transitional arrangements were notified allowing deemed export benefits to the power projects mentioned on the subject.
DEPB benefit would also be admissible on the export of composite product including assembled product having more than one constituent items for which DEPB rates are individually fixed. In such cases the DEPB entitlement would be restricted to the lowest of the rate applicable to the constituent items ignoring the rate of the constituent item(s) having weight less than 5% of the total net weight of such product. However, no DEPB benefit would be admissible on the export of such product, if any constituent item(s) is weighing more than 5% of the total net weight (of the product) and does not have any DEPB rate fixed.
A committee shall be constituted at the Zone level headed by the Development Commissioner and consisting of other concerned officials to approve units and to resolve the post-approval difficulties of the EOU/EPZ/SEZ unitSr. The Committee shall meet on Monday, every week. In case of the absence of Development commissioner, the meeting will be held by the next senior officer in the Zone. The unit shall intimate the problems being faced by them in advance. In the meetings, apart from the promoters, the other concerned agency with which difficulties are being faced by the unit, may also be called.
A decision was taken to discontinue with the proviso for submission of copy of invoices certified by the Project authority in the case of redemption under EPCG. In tune with the decision , the third sub-para of Para 5.13 (b)(i) pertaining to redemption of EPCG licence for deemed exports is deleted and the amended version of para 5.13(b)(i) is as under.
Paragraph 4.1.9 pertains to Back-to-Back Inland Letter of Credit.. It has been decided to permit Back-to-Back Inland Letter of Credit against an Advance Licence for Intermediate Supplies also. Hence the first sentence of paragraph 4.1.9 is amended by deleting the phrase ” (except Advance Licence for intermediate supply)”. The amended version of this para is as under.

The RLAs shall continue to process such applications and issue advance licences under para 4.7 of the Handbook of Procedures, Vol. 1 (1st April, 2002 – 31st march, 2007) along with the above endorsements and thereafter continue to forward the same to the ALC in the Head office as per the Policy provisions and procedures laid down for this purpose, for finalization of norms.
