To facilitate the trade, STC number/Registrations were issued to those assessees also who were not having PAN Numbers. To them registrations were given by creating TEMP (Temporary) Numbers by the department. This was done so that genuine tax payers will be able to pay their tax on time. These assessees were required to subsequently obtain PAN Number from Income Tax authorities and apply to the department to convert Temp based Registration Number into PAN based Registration Number. The short question to be considered in this appeal filed by the department is whether the view taken by the lower appellate authority that the respondent is eligible for CENVAT credit on outdoor catering service used for serving food to their employees during the period of dispute (July to December 2007) is correct or not. After hearing both sides, the learned Deputy Commissioner (AR) representing the appellant submits that the benefit is not admissible to the respondent unless they prove that no part of the cost of providing the service was recovered from their employees.
Against the backdrop of high inflation, the implementation of levy on railway freight service has been put off once again. The levy is now likely to come into force from April 1 instead of January 1 as announced earlier. This is the sixth time that the levy on transport of goods by rail has been deferred. Finance Minister Pranab Mukherjee in the 2010-11 Union Budget brought transport of goods by railway under the service tax net from April 1, 2010.
An announcement was made by Hon’ble Finance Minister in the Budget Speech 2011 for introducing a simplified scheme for the refund of service tax paid on services used for export of goods on the lines of drawback of duties.
Central Government issues Notification to Provide average Rates of Service Tax Refund for a wide Range of Goods Exported from India; Adds to E-Enabled Service Delivery to Exporting Community, Limits Public interface and Reduces Transaction Costs in obtaining Refunds The Central Government has issued a notification today to provide average rates of service tax refund, ranging from 0.03% to 0.20% of the F.O.B. value of export, for a wide range of goods exported from India. The average rate of refund is in respect of 18 identified services used beyond the factory gate. This is being done to implement the simplified scheme.
