Knowing Due date to file Income Tax Return is very Important and so is filing of Income Tax Return before the Last Date.  Filing of Income Tax Return after last date makes a taxpayer liable to Late Fees, Interest , Penalty,  Prosecution.

Section 139 of the Income Tax Act 1961 consists of different subsections governing the due dates for filing of income tax returns under various categories. There are two different categories on the basis of which the due date of filing of income tax returns / Last Date To File Income Tax Return depends-

1. Status of Asseessee

2. Quantum of slab where assesse is falling

Last date is 31st July of the Assessment Year in the following cases Last date is 30th September of the Assessment Year
Assesses covered

  • Salaried employee
  • Self employed
  • Professional
  • Freelancer
  • Consultant

Condition

  • Persons do not require an audit  to be performed for their books of accounts
Assesses covered

  • Business entity
  • Self employed
  • Professional
  • Working Partner employed in firm or a consultant  who requires to have an audit performed on his accounting books

Condition

  • All persons and entities who are required to or are liable to undergo an audit of their accounting books

Due date for Filing Income Tax Return by assesse who is required to furnish report under Section 92 E is 30th November 2018.

In simple terms the last dates for filing Income Tax Returns for the FY 2017-18. AY 2018-19 can be summarized as below-

5. Other assesses (Salaried, House Property, Interest income, Capital Gain, other sources, Business  & Prof(non audit cases) 31st July 2018
6. Belated Return Sec 139(4)  for FY 2017-18 31st March 2019
7. Original/ Belated return for Fy 2017-18  can be revised 31st March 2019

Mandatory fees for late filing of Income Tax Return under Section 234 F of the Income Tax Act 1961

Income Within Due date Upto 31st Dec Upto  31st March 2019
More than Rs. 5 lakhs Nil Rs. 5000 Rs. 10000
Upto Rs. 5 lakhs Nil Rs. 1000 Rs. 1000

It is to be noted that if the total income of the person  does not exceeds Rs. 5 lakhs then fee payable shall be Rs. 1000.

    There is a Partnership firm XYZ Enterprises with two partners A and B. A is a working partner and received remuneration. B is sleeping partner. XYZ Enterprises’ books are governed by Tax audit. Hence ITR filing by 30-9-18. My query:
    -What is the last date for filing ITR by “A” working partner.
    – What is the last date for filing ITR by “B”
    – None of A and B are under tax audit
