On August 1, 2000, the Government of India issued Notification No. 27 (RE-2000)/1997-2002, which amended the ITC(HS) Classification of Export and Import Items. The notification introduced restrictions on the import of poppy seeds (Exim Code No. 12079100). The import of poppy seeds is now restricted and allowed only under a Special Import License (SIL). The conditions for import include that poppy seeds can only be imported from select countries—Australia, Austria, France, China, Hungary, the Netherlands, Poland, Slovenia, Spain, Turkey, and the Czech Republic. Additionally, importers must provide a certificate from the competent authority of the exporting country confirming that the opium poppy was grown legally, in compliance with the International Narcotics Control Bureau’s regulations. Furthermore, all import contracts for poppy seeds must be registered with the Narcotics Commissioner in Gwalior before the importation can proceed. This amendment aims to regulate the import of poppy seeds in accordance with international narcotics control standards.

NEW DELHI: 1st August, 2000

S.O (E) – In exercise of powers conferred under section 5 of the Foreign Trade (Development and Regulation) Act, 1992 read with paragraph 1.3 and 4.1 of the Export and Import Policy, 1997-2002, the Central Government hereby makes the following amendments in the ITC(HS) Classifications of Export and Import Items , 1997-2002 published on 31st March, 1997 (RE-98) as amended from time to time, namely –

  1. After amendment the following will read as under:-
Exim Code No. Items description Policy Conditions relating to the policy Import permitted against SIL/Public Notice
120791 00 Poppy seeds Restricted Import subject to Licensing Note No. 4 below. Import permitted against SIL.

3. the Import Licensing Notes appearing in Chapter 12 of the said ITC(HS) Classifications of Export and Import Items, 1997-2002the following clause shall be inserted at the end:

“(4) Import of Poppy Seeds (Exim Code No. 120791 00) shall be allowed subject to the following conditions :

(a) Import permitted only from Australia, Austria, France, China, Hungry, the Netherlands, Poland, Slovenia, Spain, Turkey and Czech Republic;

(b) The importer shall produce an appropriate certificate from the competent authority of the exporting country that Opium Poppy have been grown licitly /legally in that country as per requirements of International Narcotics Control Bureau; and

(c) All import contracts for this item shall compulsory be registered with the Narcotics Commissioner, Gwalior prior to import.”
