In exercise of powers conferred under paragraph 2.4 of the Foreign Trade Policy, 2004-2009, as amended, the Director General of Foreign Trade hereby makes the following amendment in the Public Notice No.94 (RE-2005)/2004-2009, dated 27th March, 2006.
In exercise of powers conferred by Section 5 of the Foreign Trade (Development and Regulation) Act, 1992 read with Para 2.1 of the Foreign Trade Policy, 1stSeptember, 2004 – 31st March, 2009 (as amended from time to time), the Central Government hereby makes the following amendments in the Notification No.55 (RE-2005)/2004-2009 dated 27th March, 2006.
The principal notification was published in the Gazette of India, Extraordinary, vide number G.S.R.94(E), dated the 1st March, 2006 and was last amended by notification No.26/2006-Central Excise, dated the 22nd March, 2006 which was published in the Gazette of India, Extraordinary, vide number G.S.R.
With immediate effect, all the exporters and importers of Schedule 2 and 3 Chemicals of Chemical Weapons Convention are hereby advised to ensure that correct description of the Chemicals as well as their 8 digit HS Codes against them (as notified against Category 1A and 1B under Appendix-3 to Schedule 2 of ITC(HS) Classifications of Export and Import Items, 2004-2009, Notification No.15 dated 15.7.2005 refers) is indicated in their respective Shipping documents.

Now, therefore, in exercise of the powers conferred by section 11C of the said Act, the Central Government hereby directs that the whole of the duty of excise payable under section 3 of the said Act on such food preparations and waters, not cleared in sealed containers, falling under tariff item 2106 90 99 and 2201 90 90 respectively
