Ramchandra Vishnoi Etc. Vs Union of India (Supreme Court of India)

Introduction: In the case of Ramchandra Vishnoi and others versus Union of India, the Supreme Court of India recently granted bail to the appellants after a series of rejections. The appellants were accused of offenses under Section 132 of the Central Goods and Services Tax Act 2017. This article provides a comprehensive analysis of the judgment and the conditions imposed by the court.

Detailed Analysis

The journey of this case began with a criminal case lodged before the Court of the Special Judge/ACMM (Economic Offences), Jaipur Metropolitan, Jaipur on 10 July 2021. Subsequently, the appellants filed an application for bail, which was dismissed on 27 July 2021 by the trial court. The Additional Sessions Judge also rejected their bail application on 2 August 2021. Despite these setbacks, the final report/complaint had been filed before the ACMM on 7 September 2021.

Interestingly, the co-accused, Pravin Jangir, managed to secure bail from the High Court on 4 October, while another co-accused, Hemant Tyagi, was granted bail by the Supreme Court on 18 May 2022. This contrast in outcomes sets the stage for a crucial aspect of the Supreme Court’s judgment – equitable treatment among the accused.

Considering the prolonged custody endured by the appellants, which amounted to nearly 14 months, and the precedent set by the bail granted to co-accused, the Supreme Court intervened. It directed the release of Ramchandra Vishnoi and Himmat Singh Bhati on bail, subject to certain terms and conditions.

The conditions for the grant of bail included the deposit of any passport held by the appellants before the competent court and regular reporting to the Station House Officer (SHO) of the concerned Police Station at least once in a fortnight. These conditions aim to ensure the appellants’ availability during the trial proceedings and to prevent any potential flight risk.

Conclusion: In conclusion, the Supreme Court’s decision to grant bail to Ramchandra Vishnoi and Himmat Singh Bhati reflects a balance between the interests of justice and the rights of the accused. The judgment underscores the importance of equitable treatment and considers the circumstances of each case individually. By imposing specific conditions, the Court seeks to address any concerns regarding the appellants’ potential evasion of trial proceedings while upholding their right to liberty.
