Subject: – One-time Relaxation to those Employers who did not file ESI contribution for the contribution period April, 2019 to September, 2019 within 42 days.

Sir,

Keeping in view the problem being faced by the Employers in filing ESI contribution for the contribution period April, 2019 to September, 2019 within 42 days, the Director General, in exercise of powers vested under regulation 100, has relaxed the provisions as entered in regulation 26 of The Employees’ State Insurance (General) Regulations, 1950.

Accordingly, one-time opportunity has been given to those Employers who did not file ESI contribution for the contribution period April, 2019 to September, 2019 within 42 days after end of the contribution period. The Employers are allowed to file this contribution up to 15.05.2020. Further, it is made clear that: ‑

1. This one-time relaxation is limited to the contribution period ending September, 2019 only and no further relaxation in limitation for other contribution period is allowed.

2. Such relaxation is not extended to other older or new contribution period. In this regard it is advised to give wide publicity to the above relaxation in Local Media, Trade Associations and Employees’ Unions etc.

This issues with the approval of Director General.

Yours faithfully,
