10% redemption fine & 5% penalty of value of goods is appropriate in case of imports violating Exim Policy Provisions

Commissioner of Customs (Port) Vs Ojas International (CESTAT Kolkata) CESTAT note that the Commissioner(Appeals) has ordered reduction of redemption fine and personal penalty on the basis of ratio laid down by the Tribunal in the case of Omex International Vs. Commissioner of Customs, New Delhi reported in 2015 (328) ELT 579 (Tri.-Del.).
