The appeal by the Rajnibhai Kanada Memorial Foundation before the Income Tax Appellate Tribunal (ITAT) in Ahmedabad challenged the rejection of its application for approval under Section 80G(5) of the Income Tax Act, 1961. The central issue was whether a charitable trust’s objectives and expenditures related to Indian culture and spirituality could be classified as “substantially religious,” thereby disqualifying it from receiving the tax exemption.

The Tax Authority’s Position

The Commissioner of Income Tax (Exemption) (CIT(E)) had denied the trust’s application, citing two specific objectives (numbers 14 and 18) in its trust deed that were deemed “religious in nature.” The CIT(E) also concluded that the trust had incurred a significant amount of expenditure on religious activities. Specifically, the CIT(E) found that during the financial year 2022-23, the trust had spent ₹2,20,617 on “event expenses,” which the tax authority unilaterally categorized as religious. This amount constituted 33.52% of the trust’s total gross receipts, far exceeding the 5% limit permissible for religious expenditures under Section 80G(5B) of the Act.

The Trust’s Arguments and Judicial Precedents

The trust appealed to the ITAT, arguing that the CIT(E)’s order was flawed on two fronts. First, the trust contended that its objectives were not religious. Objective 14, which referenced spiritual centers and the promotion of Indian culture, and Objective 18, which involved teaching Indian arts, music, and traditions like folk dances and Garba, were presented as cultural and educational in nature. The trust’s representative argued that these activities were not meant to propagate any specific religion or involve ritualistic practices but were instead aimed at promoting Indian cultural heritage.
