The Ministry of Environment and Forest (MoEF) has for the first time notified e-waste management rules. The e-waste (management and handling) Rules, 2011 would recognise the producers’ liability for recycling and reducing e-waste in the country. The rules will come into effect from May 1, 2012.

NOTIFICATION
New Delhi, the 12th May, 2011

S.O. 1035(E).— Whereas, the draft rules, namely the e-waste (Management and Handling) Rules, 2010 were published by the Government of India in the Ministry of Environment and Forests vide number S.0.1125 (E), dated 14th May, 2010 in the Gazette of India, Extraordinary Part II, Section 3, Sub-section (ii) dated 14th May 2010 inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS the copies of the said Gazette were made available to the public on the 14th day of May, 2010;

AND WHEREAS the objections and suggestions, received within the said period from the public in respect of the said draft rules have been duly considered by the Central Government;

NOW, THEREFORE, in exercise of the powers conferred by sections 6, 8 and 25 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby makes the following rules, namely:-
