No Extension of Date for Filing of Returns due by 30th September for Assessment Year 2015-16 for Certain Categories of Assessees Including Companies, and Firms and, Individuals Engaged in Proprietary Business/Profession etc whose Accounts are required to be Audited; Taxpayers are Advised to file their Returns Well in Time to Avoid Last Minute Rush
Income-tax returns for Assessment Year 2015-16 for certain categories of assessees viz companies, firms and individuals engaged in proprietary business/profession etc whose accounts are required to be audited, are to be filed by 30th September, 2015. The audit report is also required to be filed by the said date.
The Government has received representations from various stakeholders seeking extension of date for filing of returns and tax audit reports beyond 30th September 2015. The reasons cited are delay in notifying the returns and related delay in availability of forms on the e-filing website.
The matter has been considered. Income-Tax Returns Forms 3,4,5,6 and 7 which are used by the above mentioned categories of assessees were notified for Assessment Year 2015-16 on 29.07.2015. The forms were e-enabled and were available on the e-filing website of the Department from 7th August 2015 giving enough time for compliance. The changes made to these forms are not extensive as compared to the earlier years. Further taxpayers entering into either international transactions or specified domestic transactions are required to file their returns by 30th November 2015 only.
After consideration of all facts, it has been decided that the last date for filing of returns due by 30th September 2015 will not be extended. Taxpayers are advised to file their returns well in time to avoid last minute rush.
Procrastination is human nature so our assessee auditees produce books of accounts only in the month of September and to overcome this problem,there should be an amendment in IT Act to file unaudited financial statements by the end of May so that we can audit properly or ONLY comment on his accounts.And we will have sufficient time also as already unaudited financial statements are submitted. Otherewise do away with tax audits as APPOINTING AUTHORITY and AUDIT FEE PAYING AUTHORITY are one and the same.He is not dependent on us but we are on him and we do not have so called INDEPENDENCE. Then deptt. can ask assessesses to get accounts audited u/s 142 and auditor will have sufficient time and independence. ICAI should think and act in the interest of members.

Government when there is no much change has taken 5 months to notifiy the forms and it expects public to comply within 45 days. How government expect this. There are festivals like Ganesh Chaturthi Dassera etc. and how to comply with this. Then why not notify forms earlier. Why it require 4/5 months time to notify forms. This is unfair. And must extend the due date at least upto 31.12.2015 as minimum 6 months from the end of financial year are given for filing and therefore minimum 6 months from the date of notification of forms are required to be given. It is a right of the assesse.
Auditors should be given sufficient time so that then can give a good report based on the requirements of Income Tax .hence the department should extend date by one more month.

What CA has to do ? Don’t we need sufficient time to conduct audit properly ? have we not lost time in filing non audit cases in the month of Aug 2015? Is it possible to conduct proper audit in such short time of 30 days ? Whether we have to audit or just file returns ? When they have not notified new forms in the month of April 2015, there is no justification in non extending due date for tax audits.
We should strongly protest against the attitude of CBDT .
This is a Sad decision since CBDT has reduced the actual time given under the act from 6 months, i.e April to Sept, to just about 2 months.
They should reconsider the decision.

Any how they had informed in advance, we should try our best to do as much as possible. My advise to CBDT or FM will be that your servers are not well equipped to handle the work on due dates, which clearly witnessed in August 2015, now during tax audit the activity will be more, though the assessees may be less, if you do not want to extend the date at least bifurcate the server traffic by giving one category of assessees Eg: Companies due date by a month or so. Dept seems working only of collection of revenue, without looking into the practicial problems faced by assessees and other involved in preparation of returns. Ultimate suffers will only be assessees.
It is very disappointing that date is not extended
If Non Taxable ITR Date extended till 7th of Sep. 15′ then only 20 days will be for audit I request from Finance Minister for extend minimum one month because we have very short time for prepare the audit . Audit Formlities are very difficult to complete.

It is not only harassing but also torturing. It is not understood how the CBDT or the Govt will suffer if date is extended. The decision making persons do not understand the practical difficulties both of professionals and taxpayers. It will be wise to get an order from any court directing CBDT to extend the date.
We Indians have the habit of asking for more. Even if extension is given in any case, even then we file the returns on the last date. Returns for one FY are filed at the end of next FY march. One should get oneself ready and accustomed to changing situations. Slowly the due date will be brought forward to August, July and so on. Get ready.

WHY NONE OF THE PROFESSIONAL FRATERNITY IS ASKING THE GOVT. TO BE READY BY 01-04 OF RELEVANT A.Y. IF ANY ONE WANTS TO FILE THEIR RETURN. THIS IS CLEARLY DOUBLE STANDARDS OF THE GOVT. AND ITS BUREAUCRATS. IN SPITE OF SO MANY COURT BATTLES LAST YEAR, THEY ARE NOT LEARNING. BEFORE ASKING SOMEONE TO COMPLY WITH THE LAWS, THEY MUST SHOW WAY TO ONE ALL. OBVIOUSLY, THEY LACK THE SPIRIT. SUCH GOVT. CAN NOT ASK ITS SUBJECTS TO FOLLOW LAWS BY LETTER AND SPIRIT. HOPE GOOD SENSES PREVAIL, AT LEAST FROM NOW.

due date of audit report filing alongwith return is not something new that has happened for the tax professionals. Return filing has noting to do with audit as auditors have to audit books of the assessee which are presumed to be closed by 31 day of march 2015. Why every time presume that date of audit filing will be extended everytime year by year. Why to ask for extension and wait start working time now

Request to extend the due date by another two months, since it is very difficult to complete with in the short span of time provided by CBDT
This is not fair on the part of department .Why they extended date for non audit cases.The audit cases are more time consuming .It is not possible to finalise the audit in a qualitative manner within such short time.They should reconsider and extend the date for a month.

It is very good news that at least they informed us in advance that they will not extend the due date But, This is very immatured statement given. On one side the due date for ordinary returns were extended up to 7th september and another side the departments are issuing notices for 2012 -2013. Auditors has to issue the qualified report but not quantified report. what is the use of giving quantified report. This has to think over by the department and Ministry. In these issues it is better to extend the time for Tax Audits.

Really it is very diappointing that the departement is not able to prescribed forms in a year time and expects thefrom the public to comply with same in 45 days . Aldo retun due date for july also extended to August .

it is really very disgusting that for the fault of the govt. in issuing forms will be suffered by we CAs and the clients. as lot of time till 7.9.2015 was used in filing non-audit ITRS due to govt. fault in notifying ITRS

Finance Ministry has to consider the request of extension of due date since now only
we came to know that for Companies All Depareciation Schedules has been changed which required lot of efforts to arrive the Date of Purchase of of Assets from the begining to wipeout as per their new slab rate. Hope they understand and do the needful.

He should consider the particle difficulty while assessing the situation.
