Overview of the Scheme
In pursuance of the announcement in Union Budget 2024-25 by Union Minister for Finance and Corporate Affairs Smt. Nirmala Sitharaman, the Central Board of Direct Taxes (CBDT) has notified the Direct Tax Vivad Se Vishwas Scheme, 2024 (referred as DTVSV, 2024) to resolve pending appeals in the case of income tax disputes. The Direct Tax Vivad Se Vishwas Scheme, 2024 has been enacted vide Chapter IV (Section 88 to 99) of Finance (No.2) Act, 2024. The Objective of the Scheme is to reduce Income tax pending litigations, generate timely revenue for Government and also to benefit Taxpayers by providing them peace of mind, certainty, and savings on account of time and resources.
The Scheme is effective from 1st October’ 2024.
The Rules and forms for enabling the Scheme have also been notified on 20th September’2024.
This scheme offers a reduced settlement amount for a ‘new appellant’ compared to an ‘old appellant’. It also benefits those who file a declaration on or before the specified deadline (i.e. 31.12.2024) by providing a lesser settlement amount than those who file after this date.
Here “Old Appellant” means: Where, Case was filed before 31/01/2020, and
“New Appellant” means: Where, Case was filed after 31/01/2020
The rationale behind such categorization is that the old appellant who was eligible for Vivad Se Vishwas Scheme of 2020 but chose not to settle his case then, gets a second chance of settlement at a premium of 10% / 5%.
Applicability of Scheme:
First of all, let us understand the meaning of “Dispute” under the Scheme.
So, “Dispute” means appeal, writ or special leave petition filed by the declarant or the income-tax authority before the Appellate Forum, or objections filed before the Dispute Resolution Panel under section 144C of the Income-tax Act, 1961 (43 of 1961) and the Dispute Resolution Panel has not issued any direction, or Dispute Resolution Panel has issued direction under sub-section (5) of section 144C of the said Act and the Assessing Officer has not completed the assessment under sub-section (13) of that section, or application filed under section 264 of the said Act;
The disputes regarding tax, interest, penalty, fees or TDS/TCS can be settled under this Scheme.
That is, Disputes/appeals, including writs and special leave petitions (Appeals), whether filed by the taxpayer or the tax authorities are pending as on the specified date, i.e. 22 July 2024 before any of the following forums:
- The Supreme Court, High Court, Income Tax Appellate Tribunal, Commissioner/Joint Commissioner (Appeals) of Income Tax, or
- Before the Dispute Resolution Panel, wherein:
- Taxpayers who have filed objections with the Dispute Resolution Panel (DRP) under Section 144C of the Income Tax Act and the DRP have not yet issued directions to the Assessing Officer (AO), or
- Taxpayers where the DRP have issued directions to the AO, but the AO has not issued a final assessment order.
- Revision petitions pending before the Commissioner of Income Tax under Section 264 of the Income-tax Act.

Moreover, if the Case is settled and Determined Tax Arrears including Penalty & Interest, if any, is duly paid under the Scheme, Taxpayer is granted Immunity from initiation of any proceedings in respect of an offence and imposition of penalty or interest for the matters opted under the Scheme.
Forms notified for DTVSV Scheme, 2024
Four separate Forms have been notified for the purposes of the DTVSV Scheme,2024. These are as under:
- Form-1: Taxpayers to file this Form for filing declaration of their intention to settle the tax dispute and undertaking to withdraw any pending legal proceedings. Each dispute requires a separate Form-1. The declaration and undertaking must be verified by the taxpayer, or a person authorized to verify their Income tax return.
- Form-2: Form for Certificate to be issued by Designated Authority. The Designated Authority shall issue Form -2 within a period of fifteen days from the date of receipt of the declaration to determine the amount payable by the taxpayer.
- Form-3: Taxpayers to provide intimation of Payment in Form-3, as determined in Form-2 and is to be furnished to the Designated Authority along with proof of withdrawal of appeal, objection, application, writ petition, special leave petition, or claim. The declarant must pay the determined amount within ‘fifteen days’ of receiving the certificate.
- Form-4: Upon receipt of Form-3, Order for Full and Final Settlement of tax arrears by the Designated Authority.
The order determining the amount payable is conclusive, and the matters covered cannot be reopened in any other proceeding.
Consequences of Non-Compliance:
- False Particulars: If any information provided in the declaration is incorrect or misleading, the declaration will be considered invalid.
- Violation of Conditions: If the taxpayer fails to comply with the terms and conditions of the scheme or acts in a way that contradicts their undertaking, the declaration will be considered invalid.
- Revival of Proceedings: In both cases of submission of false particulars and violation of conditions, any previously withdrawn legal proceedings and claims shall be deemed as reinstated.
Highlights of Latest CBDT Circular dated October 15, 2024.
Section 97 of the DTVSV Scheme, 2024 empowers the Board to issue directions or instructions in public interest, in pursuance of which, CBDT has issued Guidance Note No. 1/2024 in the form of answers to the frequently asked questions (FAQs). This will be helpful for the Taxpayers for creating better awareness and understanding with respect to the provisions of the Scheme.
The CBDT Circular No. 12/2024 provides essential guidance for taxpayers to settle their disputes under the DTVSV Scheme, avoiding prolonged litigation. With clear instructions on eligibility, payment timelines, and procedural forms, the Circular simplifies the resolution process.

(i) Declaration and Undertaking shall be filed by taxpayer in Form- 1 on or before 31.12.2024 to keep the amount payable on the lower threshold. In case of filing the declaration and undertaking beyond 31.12.2024, amount payable will increase as specified in rates Table-1 above. (ii) The Designated Authority shall issue Form-2 within a period of fifteen days from the date of receipt of the declaration to determine the amount payable by the taxpayer. Search assessments | ||||||||||||||||||||||
6 | Kindly clarify which assessments shall be considered to have been made on the basis of search initiated under section 132/132A of the Act? | Assessments framed under section 153A or 153C are clearly made on the basis of search-initiated u/s 132/132A. Therefore, such cases shall not be eligible for the DTVSV Scheme, 2024.
For other cases where assessments have been made U/S 143(3)1144/ 147, following three sets of cases shall be considered as cases where assessments have been made on the basis of search initiated u/s 132/ 132A. These cases are: – (i) Where a search is initiated Under section 132 or books of account, other documents or any assets are requisitioned under section 132A, on or after the 1st day of April, 2021, in the case of the assessee and assessments have been made consequently; or (ii) Where the Assessing Officer has drawn satisfaction, with the prior approval of the Principal Commissioner or Commissioner, that any money, bullion, jewellery or other valuable article or thing, seized or requisitioned under section 132 or section 132A in case of any other person on or after the 1st day of April, 2021, belongs to the assessee and assessments have been made consequently; or (iii) Where the Assessing Officer has drawn satisfaction, with the prior approval of Principal Commissioner or Commissioner, that any books of account or documents, seized or requisitioned under section 132 or section 132A in case of any other person on or after the 1st day of April, 2021, pertains or pertain to, or any information contained therein, relate to, the assessee and assessments have been made consequently. |

As per CBDT Circular 15/2015 dl. 10.6.2015-
“The applicant does not have the option to choose the years for which it wants to apply for rollback. The applicant has to either apply for all the four years or not apply at all. However, if the covered international transaction(s) did not exist in a rollback year or there is some disqualification in a rollback year, then the applicant can apply for rollback for less than four years. “ Thus, in certain exceptions, the rollback period could be less than 4 years also. On the same analogy, if few years are settled in the Scheme, the rollback can be applied for the remaining years. |

8 | Suppose a taxpayer is eligible to apply for DTVSV Scheme, 2024 as his appeal is pending as on 22.7.2024 . But subsequently, before the taxpayer could file declaration under the DTVSV Scheme, 2024, his appeal has been disposed off, Can such a taxpayer still file declaration under the Scheme? | The DTVSV Scheme, 2024 is a Scheme for settlement of tax disputes. Where a decision has been given prior to the taxpayer filing a declaration, there is no dispute pending unless the taxpayer or the Department again prefers an appeal. Therefore, where an appeal is pending as 011 22.7.2024 but is not pending as on the date of making declaration under the Scheme, such cases shall not be eligible for the Scheme.

Settling issues in Part | ||||||||||||||||||||||
10 | Where disputed tax contains qualifying tax arrears along-with nonqualifying tax arrears (such as, tax arrears mentioned in section 96(a) for e.g. tax arrear in respect of undisclosed foreign income), whether the taxpayer can apply for the Scheme in such a case? | As per section 91 (2) of the Scheme, after filing of declaration, appeals before ITAT /CIT(A)/ JCIT(A) are deemed to be withdrawn from the date of issue of certificate by the Designated Authority. Further as per section 91(3) of the Scheme, the taxpayer IS required to withdraw appeals and furnish proof thereof along with intimation of payment u/s 92(2) of the Scheme.
Therefore, the Scheme does not envisage settling issue in part. The dispute has to be settled in full as per the Scheme. Thus, where there are non-qualifying tax arrears, such disputes are not eligible to be covered under the Scheme. |

Settling penalty appeal while quantum appeal pending | ||||||||||||||||||||||
11 | Can a taxpayer settle penalty appeal while continuing to litigate the associated quantum appeal? | Reference may be made to section 89(1)(i) of the Scheme, which provides the definition of ‘disputed penalty ‘. It provides that the disputed penalty is such penalty which is not levied or leviable in respect of disputed income or disputed tax.
Thus, it would not be possible for the appellant to apply for settlement of penalty appeal only, when the appeal on disputed tax related to such penalty is still pending. If both quantum appeal covering disputed tax and appeal against penalty levied on such disputed tax for an assessment year are pending, the declarant is required to file a declaration form giving details of both disputed tax appeal and penalty appeal. However, he would be required to pay relevant percentage of disputed tax only. |

12 | If there is substantive addition as well as protective addition in the case of same assessee for different assessment year, how will that be covered? 22 | Where assessee settles TDS liability as deductor of TDS under DTVSV Scheme, 2024 (i.e. against order u/s 201), when will he get consequential relief of expenditure allowance under proviso to section 40(a)(i)/(ia) of the Act? | In such cases, the deductor shall be entitled to gel consequential relief of allowable expenditure under proviso lo section 40(a)(i)/(ia) of the Act in the year in which the lax was required to be deducted, if the disallowance under section 40(a)(i)/(ia) of the Act is with respect Lo same issue on which order under section 201 has been issued.
However, if the assessee has already claimed deduction of the same amount under section 40(a)(i)/(ia) of the Act in subsequent year on account of recovery of IDS in such subsequent year, he shall not be entitled to consequential relief under section 40(a) (i)/(ia) of the Act on the basis of the settlement under DTVSV Scheme, 2024. In case, in the order under section 143(3) there are other issues as well, and the appellant wants to settle the dispute with respect to order under section 143(3)of the Act as well, then the disallowance under section 40(a)(i)/(ia) of the Act relating to the issue on which he has already settled liability under section 201 of the Act would be ignored for calculating disputed tax. |

Other Key Provisions related to Carry forward of Losses, Unabsorbed Depreciation and MAT Credits covered under the Scheme-
- Computation of Disputed Tax in cases where loss or unabsorbed depreciation is reduced:
Option 1- Pay the tax, including surcharge and cess, payable on the amount by which loss or unabsorbed depreciation is reduced and carry forward losses/unabsorbed depreciation after ignoring such reduction.
Option 2– After considering reduction, Carry forward the reduced amount of loss or unabsorbed depreciation.
Further proviso provides that where option 2 is exercised- the Taxpayer would be liable to pay tax, surcharge, cess and interest, if any, as a consequence of carrying forward the reduced amount of loss or unabsorbed depreciation in subsequent years.
Also, Provided that the written down value of the block of asset on the last day of the year, in respect of which unabsorbed depreciation has been reduced, shall not be increased by the amount of reduction in unabsorbed depreciation.
- Computation of Disputed Tax in cases where MAT Credit is reduced:
Similarly, as in case of Carry forward losses/ Unabsorbed depreciation, treatment of MAT Credit shall be as under-
Option 1: Pay the amount by which MAT credit to be carried forward is reduced in disputed tax and carry forward the MAT credit after ignoring such amount of reduction.
Option 2: After considering reduction, Carry forward the reduced MAT credit.
Persons Barred from making a Declaration under the Scheme
In terms of clauses (b) to (e) of Section 96 of the Scheme, the following persons are barred from making a declaration for any tax arrears for any assessment year:
- Any person in respect of whom an order of detention has been made under the provisions of the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act, 1974, on or before the date of filing of declaration.
- Any person in respect of whom prosecution for any offence punishable under the provisions of the Unlawful Activities (Prevention) Act, 1967, the Narcotic Drugs and Psychotropic Substances Act, 1985, the Prohibition of Benami Property Transactions Act, 1988, the Prevention of Corruption Act, 1988, the Prevention of Money-Laundering Act, 2002, has been instituted on or before the filing of the declaration.
- Any person convicted under UAPA/NDPS Act/PBPT Act/PC Act/PMLA;
- Any person in respect of whom prosecution has been initiated by an Income-tax authority for any offence punishable under the provisions of the Bharatiya Nyaya Sanhita, 2023 or for the purpose of enforcement of any civil liability under any law for the time being in force, on or before the filing of the declaration.
- Any person convicted of any such offence consequent to such prosecution initiated by an Income- tax authority.
- Any person notified under section 3 of the Special Court (Trial of Offences Relating to Transactions in Securities) Act, 1992, on or before the date of filing of declaration.
Other Key Considerations-
- For the banned persons, It should be noted that there is a complete ban on declaration with respect to the person and not merely with respect to any tax arrears.
- It should be noted that the mere issue of notice for prosecution does not amount to the prosecution being instituted and would not bar the Assessee from making a declaration. Further, the Assessee can declare even if prosecution has been instituted if prosecution is compounded before filing the declaration.
- The Scheme is not available for settling disputes pending before the Authority of Advance Ruling (AAR). However, if the order passed by AAR has determined the total income of an assessment year and the writ against such order is pending in the high court on the specified date, the appellant would be eligible to declare and settle the dispute under the Scheme. If the order of AAR has not determined the total income, it would not be possible to calculate disputed tax, and hence, such cases would not be covered.
- The proceedings pending before the Income-tax Settlement Commission (ITSC) are not eligible for a settlement under this Scheme.
Conclusion:
The scheme is designed to offer Taxpayers, an opportunity to resolve pending income tax disputes by waiving all outstanding penalties and interest. It incentivises the Taxpayers to settle long outstanding Tax dues and to reduce litigation Costs.
The scheme aims to resolve the litigation burden on taxpayers and clean their balance Sheets as well as benefits the Tax Administration & Authorities by providing to all, a streamlined process and reduced settlement amounts. The availability of clear rules and forms and the option to file electronically further simplifies the settlement process, more specifically the queries of Taxpayers are duly addressed vide CBDT Circular dated 15th October’2024.
Taxpayers facing pending tax disputes should promptly file the declaration under the Scheme to avail the benefits, obviously after going through the eligibility criteria of the DTVSV Scheme to determine if it is a suitable option for them. However, the High-Pitched Assessments are not suggestible to opt for the Scheme.
