As you are aware, it is mandatory for AOs to file Form No. 24G on monthly basis with in the prescribed time. Based on the particulars reported in Form No. 24G, Book Identification Number (BIN) is generated and intimated to the respective AOs by TIN Central System. AOs can download BIN from TIN Portal. AOs are required to intimate the BIN so generated to the concerned DDOs in respect of whom the sum deducted has been credited. Subsequently, the BIN is to be reported by the DDOs in the quarterly TDS/ TCS statements.

In case of delay in filing of Form No. 24G by the AOs, there would be delay in generation of BIN and subsequent intimation of the same by the PAOs to the concerned DDOs. This contributes towards delay in filing of quarterly TDS/ TCS statements resulting into levy of late filing fee u/s 234E of the I.T. Act (a sum of Two Hundred Rupees for every day during which the failure continues) on the deductors.Late filing of TDS statements also results into the TDS Credit not being available to the deductees (employees / vendors) for claiming the amount of tax already deducted from the payments made to them besides generating correct TDS Certificates for them.

From the records it is noticed that there was an inordinate delay (more than 3 weeks) on your part in filing of Form No. 24G for various months during current financial year i.e. 2013-14. As indicated above this has caused inconvenience to deductors and the taxpayers.

In view of the above, and the fact that the due date of filing of Form No. 24G for the month of December, 2013, which is 10th January, 2014, is approaching fast, you are advised to file Form No. 24G for the month of December, 2014 well within the due date so that the DDOs are also able to file there quarterly TDS/TCS Statements for third quarter of FY 2013- 14 with in the due time and avoid levy of fee u/s 234E of the I.T. Act.

    Dear Sir,
    We have to atleast appreciate the laws/rules makers who have made act/rules for penalizing and collecting LATE FEES for late filing FORM 24Q/26Q/27EQ etc. etc. @Rs. 200/= per day u/s 234E and the guilty GOVERNMENT AOs (GOVERNMENT A.O.s has to pay neither LATE FEES or PENALTY under any section) who file their FORM 24G very late(after due date) and who are supposed to issue BIN to GOVERNMENT DDOs, and these poor GOVT. DDOs are bound to pay the LATE FEES u/s 234E not due to the fault of GOVERNMENT DDOs. HATS OFF TO THE RULE MAKERS.
