Public Notice No. 64/2002-07, issued on February 19, 2003, introduces several amendments to the Export and Import Policy for the period 2002-07. Notably, it revises the definition of “newcomers” in the context of licensing. Manufacturing companies (excluding proprietorships and partnerships) with a domestic presence will not be considered newcomers if they meet specific criteria, such as registration with Central Excise and State Sales Tax authorities, payment of taxes, submission of an audited balance sheet, and a minimum investment in plant and machinery of Rs 50 lakhs. Furthermore, the notice updates Appendix 28A, adding new ISO 9000 certification agencies, and includes new agencies in Appendix 35B authorized to issue Certificates of Origin (Non-Preferential), such as the Indian Electrical & Electronics Manufacturers Association in Delhi and the Indo German Chamber of Commerce in Mumbai. These amendments aim to streamline procedures for manufacturing companies and improve the efficiency of certification processes, benefiting exporters.

In exercise of powers conferred under paragraph 2.4 of the Export and Import Policy, 2002-07, the Director General of Foreign Trade hereby makes the following amendment in the Handbook of Procedures (Vol.1):-
1) The following is added at the end of para 4.6 pertaining to “Newcomers”:
However manufacturing companies ( not proprietorships and partnership firms), who have domestic presence are not to be treated as newcomers if the following conditions are met:
a) The company is registered with Central Excise authorities and has paid central excise (unless exempted) ,
b) The company is registered with State sales tax authorities and has paid sales tax ( unless exempted)
c) The company furnishes copy of their audited balance sheet
d) The minimum investment in plant and machinery must be Rs 50 lakhs
In such cases the licencing authority would endorse the licence with the condition that the bond/ BG shall be furnished as per the terms and conditions stipulated by the Department of Revenue .
2) The following amendments / additions are made in Appendix 28 A pertaining to the “List of ISO 9000 ( Series) Certification Agencies” as under:
