The Ministry of Commerce & Industry’s Notification No. 30/2025-26, dated 18 September, 2025, amends the import policy for ATS-8, a chemical listed under Chapter 29 of the ITC (HS), 2022. With immediate effect, the import of ATS-8 having a Cost, Insurance, and Freight (CIF) value of less than US$111 per kilogram is classified as ‘Restricted’ until 30 September, 2026. This is a revision from its previous ‘Free’ import status. The new minimum import price (MIP) condition is not applicable to certain categories of importers. This includes those with Advance Authorization, Export Oriented Units (EOUs), and units operating in Special Economic Zones (SEZ). The exemption for these units is contingent on the condition that the imported materials are not subsequently sold into the Domestic Tariff Area (DTA). The notification’s effect is a new restriction on low-cost ATS-8 imports, while allowing certain export-focused entities to continue importing freely under specific terms.

Subject: Amendment in Import Policy Condition of ATS-8 covered under Chapter 29 of ITC HS, 2022, Schedule —I (Import Policy)-regarding.

S.O. 4235(E): In exercise of powers conferred by Section 3 and Section 5 of Foreign Trade (Development & Regulation) Act, 1992, read with paragraph 1.02 and 2.01 of the Foreign Trade Policy (FTP) 2023, as amended from time to time, the Central Government hereby amends the Import Policy Condition of the following HS codes covered under Chapter 29 of ITC (HS), 2022, Schedule — I (Import Policy) with immediate effect, as under:

2. MIP condition on the above items shall not be applicable for imports by Advance Authorization holders, Export Oriented Units (EOUs) and units in the SEZ, subject to the condition that the imported inputs are not sold into the Domestic Tariff Area (DTA).

Effect of the Notification:

Import of ATS-8 {(4R-Cis)-1,1-Dimethylethy1-6- cyanomethyl-2,2-dimethyl-1-3-dioxane-4-acetate} under Chapter 29 of ITC (HS), 2022, Schedule — I (Import Policy), having a CIF value of less than US$111 per kg, is ‘Restricted’ till 30.09.2026, with immediate effect. However, inputs imported by Advance Authorization holders, EOUs and SEZ shall be exempted from the MIP condition.

This is issued with the approval of the Minister of Commerce & Industry.
