Circular No. 35/2009-Custom Duty

Sub: Application of Kimberley Process Certification Scheme (KPCS) to Semi- cut diamonds- reg.

Attention is drawn to Circular No. 53/2003-Cus dated 23rd June, 2003 issued under F.No.314/33/2002-FTT laying down procedure for implementing Kimberley Process Certification Scheme (KPCS) for certification of rough diamonds.

‘2. Kimberley Process Certification Scheme Secretariat, Namibia’ has now clarified vide a press release dated 30 November 2009 (copy enclosed) that “polishing a single or a few small facets will not transform rough diamonds into polished diamonds and make these fall off the KPCS radar and that semi-cut diamonds and their import or export remains subject to the requirements of the KPCS”.

3. Therefore, semi-cut diamonds should be subjected to the requirement of production of certificate under the KPCS.

4. Wide publicity may please be given to these instructions by way of issuance of Trade/Public Notice. Difficulties, if any, in implementation of these instructions, may be brought to the notice of the Directorate General of Export Promotion, New Delhi.

5. Receipt of this circular may kindly be acknowledged.
