Registration requirement of any Project under RERA – How the limit of more than 500 Sq. mtrs. or more than 8 apartments is to be seen?
Sec.3(2) of RERA gives the conditions in which the registration is not required for any project. It reads as under:
(2) Notwithstanding anything contained in sub-section (1), no registration of the real estate project shall be required—
(a) where the area of land proposed to be developed does not exceed five hundred square meters or the number of apartments proposed to be developed does not exceed eight units inclusive of all phases:
For Example:
1. Land area to be developed 400 Sq. mtrs. And No. of apartments 9 – Yes registration required
2. Land area to be developed 600 Sq. mtrs. And No. of apartments 7 – Yes registration required
3. Land area to be developed 600 Sq. mtrs. And No. of apartments 9 – Registration required

Ans. Yes. Every real estate project which has land area more than 500 sqmts or has more than 8 apartments needs to be registered

Real Estate Project Registration Process:
STEP 1 PROMOTER DETAILS:
1. Promoter details: Type of promoter Name, Pan No., Email, Mob. No., Address, Company Reg. No., etc.
2. Authorized signatory: Name, Email, Mob. No. , Address, photograph.
3. Project head: Name, Email, and Mob. No., Address, photograph.
4. RERA Reg. No. Earlier: If applicable of other state or other project.
5. Previous project Detail: Last five Years: Project name, project description, Address (Nil document to be uploaded in case of new promoter)
STEP 2 PROJECT DETAILS: FOR REGISTRATION
Project Name, Project Description, Project Type, Project Status, Project Starting Date and project End Date, Total Area of Land, Total Open Area ,Total Covered area ,Project Address, Authority, Physical Application Submission Office, Application No. Garage Available for Sale, Total Area of Garage, No. of Open Parking, Area of Open Parking, No. of Covered Parking, Total Area of cover Parking, Estimated cost of construction, Land Cost(IRS),Total Project Cost.
Development Details for Registration
Type of Inventory, No. of inventory Available for Sale ,Carpet Area (sq.mtr.), Area of exclusive balcony/verandah(sq.mtr.), Area of exclusive open terrace (sq.mtr.).
Internal Development Work for Registration
Road system, Water Supply, Sewage and Drainages, Electricity supply, Solid Waste Management
Project Bank Details for Registration
Bank Detail, Branch Name, Account Number, IFSC code.
Project Agent Detail for Registration if Applicable
Agent Registration No. of RERA, Agent Name, Agent Address.
Project Architect Detail for Registration
Name, Email Id, Address, No. of key Projects completed, Reg. No. With COA.
Project Structural Engineer Detail for Registration
Name, Email Id, Address, No. of key Projects completed, Local Authority License No.
Project Contactor Detail for Registration
Name, Email Id, Address, No. of key Projects completed, Year of Establishment.
STEP 3 is to uploading of Project Documents (a complete list is provided in RERA website)
STEP 4 is payment of online fees
STAGE 5: Hard copies of following documents self attested to be submitted within 3 working days to concerned office:
1. Application Documents
2. Fee Receipt
3. Email acknowledgement printout
4. 2 CDs with high resolution files as uploaded
5. RERA Portal Application Submission printout
We have sold 14 flats after completion in 2019. 2 Flats among 14 were with attached terrace. Now we have got extension plans for 2 flats on the terrace. Do i need to take RERA number for 2 flats

we are 4 partners of land and we have given our land to the builder for development, in this case,
1) Builder have section a plan of 8 flats and land is less than 500mtrs. then is there required RERA Registration?
2) Plan is sectioned on January2018 but still builder has not started work yet on that land, So Can builder start work of building without RERA Registration?
3) We had a registered power of atterny in between builder and we all Partener, eventhough builder has not done RERA registration, So is there required our all partners present for the same?
Can you please help us to provide above information for our knowledge and solve the existing issue?

our society has passed resolution that we have to vacate the premises in july 2018. The developer will register personnel agreement .
After we vacate the flat developer will demolish the society building . and thereafter he will demolish the building and apply registration under rera.
PLEASE GUIDE RERA REGISTRATION IS AFTER DEMOLITION OF BUILDING OR BEFORE VACATING OUR FLATS.
