FAQs on  FOOD License under FSSAI

1. Who Needs FSSAI/FOOD License?

Every person who is doing food business needs FSSAI/FOOD license as per the Food Safety Standard Act.

2. What is FSSAI?

♦ FSSAI stands for Food Safety and Standards Authority of India which is an organization that monitors and governs the food business in India. It is an autonomous body that is established under the Ministry of Health & Family Welfare, Government of India.

♦ The FSSAI has been established under the Food Safety and Standards Act, 2006 (FSS Act) which is a consolidating statute related to food safety and regulation in India. It ensures the food products undergo quality checks thereby curtailing the food adulteration and sale of sub-standard products. It is responsible for the registering and licensing of the Food Business Operators (FBO) in India and it lays down the rules and regulations for running the food business in India.

3. Kind of Business who needs FSSAI/FOOD License?

The kinds of Business who needs FSSAI/ Food License are listed below:

  • Petty Food Business Operators (e.g., Gol-Gappa stall, fruits/vegetables vendors, snacks stall, Tea Stall, Temporary Food Stalls etc.);
  • Dairy Units including Milk Chilling Units;
  • Vegetable Oil Processing Units;
  • Slaughtering House;
  • Meat Processing;
  • All Food Manufacturing/ Processing units other than Dairy Units,
  • Vegetable Oil, Meat Processing and Slaughtering Houses;
  • Proprietary Food;
  • Food or Health Supplements and Nutraceuticals etc.;
  • Non-specified food;
  • Radiation processing of food;
  • Substances added to Food;
  • Storage Facility;
  • Wholesaler;
  • Distributor;
  • Retailer;
  • Hotel;
  • Restaurants;
  • Club/Canteen;
  • Caterer;
  • Food Vending Agencies;
  • Dhaba;
  • Exporter;
  • E-Commerce Operator

4. What are types of FSSAI Registration and License?

  • There are three Types of FSSAI/ Food License

a. FSSAI Registration

b. FSSAI State License

c. FSSAI Central License

The applicability of the above three license depends on various parameters however the most common parameter is annual turnover–

  • Basic Registration – If the annual turnover of the business is less than 12 lakhs then the food business operator shall get registered with Registration Form A.
  • State License – If the annual turnover of the business is between 12 to 20 crores then the food business operator shall apply for State license Form B
  • Central License – If the annual turnover of the business is above 20 crores, then the food business operator shall apply for Central License Form B.

5. What if the food business operator is running food business from various locations?

  • If you are running a food business in multiple locations, then you have to apply for numerous food licenses. Every place where the food is getting handles, separate Food FSSAI License is issued.
  • For Example: if you are a Private Limited Company and having a registered office in Gujarat and you are operating at 5 different locations across India. Then you need to get a central license for your registered office address and also you need separate license for location depending on your turnover.

6. What is FSSAI Registration Statutory Fees?

  • The applicant/FBO needs to pay the fees while submitting the FSSAI registration form. The FSSAI registration fee for different types of registration are as follows:

a. FSSAI Basic Registration – Fee of Rs.100

b. FSSAI State License – Fee between Rs.2,000 to Rs.5,000 (Depends on the type of business carried out)

c. FSSAI Central License – Fee of Rs.7,500

7. If medical stores are selling dietary food, do they need to get a license for selling dietary foods and or plant-based supplements (nutraceuticals)?

  • All Food Business Operators and, including medical stores, have to get FSSAI license/registration.

Some Important Points

1. The license must be renewed 120 days before its expiry.

2. The extension of the renewal is also for 1 to 5 years. The cost of renewing will also increment depending on the extension period.

3. If one fails to renew the license before its expiry, then he or she will be charged Rs. 100/- each day from the day of expiry till the renewal.

4. With effect from October 1, 2021, the Food Safety and Standard Authority of India (FSSAI) have mandated the display of FSSAI Registration number of the Food Business Operators to be on every bill, invoice, cash receipt/cash memo.

5. Apart from obtaining FSSAI Registration/ License, Food Business Operators has to follow FSSAI Act, Rules made under FSSAI Act, FSSAI Regulation, FSSAI Guidelines/ Circulars/ Directions etc.

6. One must hire/ consult a Professional who practice in FSSAI Laws for obtaining FSSAI Registration/ License & its renewal, filing various FSSAI returns and for obtaining proper guidance of rules and regulations to be followed.
