 EXTENSION OF TIME FOR UPLOADING/ONLINE SUBMISSION OF ANNUAL FCRA RETURNS FOR THE YEAR 2019-20

PUBLIC NOTICE

Subject: EXTENSION OF TIME FOR UPLOADING/ONLINE SUBMISSION OF ANNUAL RETURNS FOR THE YEAR 2019-20-  Regarding.

As per rule 17 of the Foreign Contribution (Regulation) Rules, 2011, every person who receives foreign contribution under the Foreign Contribution (Regulation) Act, 2010, shall submit a signed or digitally signed report in electronic form in Form FC-4 with scanned copies of income and expenditure statement, receipt and payment account and balance sheet for every financial year beginning on the 1st day of April within nine months of the closure of the financial year.

2. The Foreign Contribution (Regulation) Act, 2010 has been amended by the Foreign Contribution (Regulation) Amendment Act, 2020. As per the amended provisions of the Act and Rules made thereunder, the FCRA registered associations and prior permission (PP) holders as well as prospective seekers of registration or PP are required to meet, inter alia, the following conditions: –

(i) Open a mandatory “FCRA Account” in the State Bank of India, New Delhi Main Branch, 11, Sansad Marg, New Delhi- 110001;

(ii) Upload Aadhaar details of all office bearers or Directors or other key functionaries by whatever name called;

(iii) Upload affidavits of all members as prescribed in rule 9(1)(a) of the Foreign Contribution (Regulation) Rules, 2011 &

(iv) Obtain Darpan ID from DARPAN Portal of NITI Aayog of the NGO/Association.

3. It has been brought to the notice of the Ministry that these new conditions may require some additional time by Associations.

4. Therefore, considering above, in exercise of the powers conferred by section 50 of the Foreign Contribution (Regulation) Act, 2010, the Central Government hereby extends the time for uploading/online submission of annual returns for the year 2019-20 up to 30th June, 2021.

    It was unfortunate that the last date for filing 2019-20 FCRA was not extended.
    If the honourable ministry and officers concerned not focused on penalty and same focus to the pandemic which was unheard of in history was considered and extended the date at least one month it would have been a human deed atleast.
    Suffering humans,
    Lockdown in different part of the country,
    Panic striken community ,
    New additions in the Return format,
    Opening New Bank account.- The bank opened many accounts on 30.06.2021 and later at least it would have served as an eye opener it would have been wise.

    Why to say all these the pandemic situation itself is a good reason for favouring an extension on humanitarian and citizen centric decision .
    for any citizen welfare stae.

    Respected sir,

    I am P.Jesu Mary, president of Gowtham Welfare Society established in Guntur, Andhrapradesh,in the year 2001 especially for the rehabilitation of Mentally retarded children.Please forgive us for not filing FCRA returns for FY 2019-20. My husband, daughter and I suffered with COVID 19 and in that tension we forgot to file the FCRA returns.Kindly give us one opportunity to file returns without levying penalty as our NGO is a small organization and could not pay the heavy penalty.

    Sir I beg you please pardon our penalty amount.. Many NGO’s are not able to open account with SBI, NDMN. Within given dates. Due covid19 situation. Please allow us to upload FC4 and apply for FCRA renewal. We are in much difficulty. Please have Mercy. Once again begging for mecry on penalty amount.

    Sir, please extention one month. As because we have recent opened sbi account, newdelhi due to pandemic. So please consider.

    Why we need to furnish SBI account details at the time of filing Annual return for F.Y. 2019-20? New amendments come into effect from 20.09.2020. It should be applicable for FY 2020-21 onwards. Due to covid situation trustees are not available for signatures because of health and safety reasons. Request Ms. Sitharaman to not to levy penalty for not filing FCRA return before 30th June.

    SIR, PLEASE EXTEND 1 MONTH MORE TO SUBMIT ANNUAL RETURNS 2019-20. DURING LAST WEEK OF JUNE IT WAS LOCK DOWN IN THIS AREA. MORE OVER PENALTY FOR DELAY IS CALCULATED FROM JAN.21 AND TOO MUCH WE REQUEST TO GIVE A LAST CHANCE FOR FILING

    DARPAN ID NOT RECEVED SO FAR, UPLOAED ALL INFORMATION ON 28.6.21 AND ENABLE TO OPEN FCRA ACCOUNT IN SBI PARLIAMENT IS DUE DATE FOR FILING FC 4 RETURN EXTENDING ,
    2 IN LAST FOUR YEAR WE HAVE NOT RECEICED FOREIGN DONATION . WHAT IS CONCEQUENCE FOR LATE FILING OF RETURN
