Compliances Forms Due between 01/04/2020 to 31/05/2021

Ministry of Corporate affairs vide its General Circular No. 06/2021 Dated: 03/05/2021 has grants relaxation to the Companies and LLP to file the forms due between 01/04/2020 to 31/05/2021 without any additional fees upto 31/07/2021 except the forms CHG 1, CHG 4 and CHG 9.

Forms Related with Creation or Modification of Charge

Ministry of Corporate affairs vide its General Circular No. 07/2021 Dated: 03/05/2021 has grants relaxation to the Companies to file the forms CHG 1 and CHG 9 for the creation or modification of charge as below :

Case 1 : All the charges created or modified before 01/04/2021 but the timelines for furnishing such forms not expired on 01/04/2021 can be filed with ROC without any additional fees by 31/05/2021

Case 2 : All the charges created or modified between 01/04/2021 to 31/05/2021  can be filed with ROC without any additional fees by 31/07/2021.

This circular shall not apply in cases :

1. Form CHG 1/CHG 9 is already filed before the issuance of this circular

2. The timeline is already expired u/s 77 and 78 prior to 01/04/2021.

3. The timeline for filing the forms expires a future date, despite exclusion of the time provided in case 2

4. Filing of Form CHG4.

Holding of Board Meetings for first Two quarters

The gap between holding of board meeting is extended from 120 days to 180 days (its only for first two quarters which means any board meeting after 30.09.2021 shall be hold within 120 days from the date of previous board meeting) as per the MCA circular General Circular No. 08/2021 Dated: 03/05/2021
